Abstract

Tujuan penelitian ini adalah untuk penerapan penegakan hukum pidana terhadap seorang ibu yang membunuh anaknya yang baru lahir sesuai dengan KUHP serta pertimbangan hukum terhadap putusan Nomor 285/PID.B/2021/PN PSP. Metode penulisan penelitian ini menggunakan metode penelitian normatif karena berlandaskan peraturan perundang-undangan dan doktrin, dengan menelaah dari sisi aturan hukum yang ada dan keterkaitannya dengan kasus-kasus yang telah terjadi sebelumnya. Hasil dan kesimpulan dari penulisan penelitian ini adalah bahwa seseorang ataupun semua anak memiliki hak untuk hidup yang di mana telah tercantum pada Hak Asasi Manusia yang menjelaskan mengenai seseorang memiliki haknya untuk menyambung kehidupannya. Kejahatan pembunuhan kepada anak yang diperbuat oleh ibu kandungnya sendiri sudah jelas diatur dalam Pasal 341 KUHP. Kata Kunci : Penegakan Hukum, Anak, Ibu, Tindak Pidana, Pembunuhan. / The purpose of this study is to apply criminal law enforcement against a mother who killed her newborn child in accordance with the Criminal Code and legal considerations for decision Number 285/PID.B/2021/PN PSP. The method of writing this research uses normative research methods because it is based on legislation and doctrine, by examining in terms of existing legal rules and their relationship to cases that hace occurred before. The results and conclusions of this research writing are that a person or all children have the right to life which is stated in Human Rights which explains that a person has the right to continue his life. The crime of murder of a child committed by his own biological mother is clearly regulated in Article 341 of the Criminal Code. Keywords : Law Enforcement, Child, Mother, Criminal Offense, Murder
