Abstract
Indonesia adalah negara yang terbuka terhadap perkembangan zaman yang pada saat ini menuju era digital dengan cukup baik. Seiring perkembangan zaman, aktivitas masyarakat tidak akan terlepas dari bantuan teknologi. Kemajuan teknologi informasi serta inovasi finansial telah menciptakan sistem keuangan yang sangat kompleks, dinamis, dan saling terkait. Agar kegiatan masyarakat tetap dalam pengawasan dan perlindungan, maka terbentuklah Otoritas Jasa Keuangan (OJK) sebagai lembaga negara Independen yang bergerak di bidang finansial. Peranan OJK dalam hal ini adalah memberikan pengawasan pada Perusahaan-perusahaan Financial Technologi khususnya aplikasi pinjaman online yang saat ini banyak menyalahgunakan data pribadi konsumen saat melakukan transaksi keuangan secara online, pengaturan perlindungan data pribadi di Indonesia telah diatur melalui aturan POJK Nomor 10 Tahun 2022. Perusahaan Fintech dilarang menyalahgunakan data pribadi konsumen, namun masih sering terjadi penyalahgunaan kewenangan tersebut, karena sanksi dalam aturan tersebut masih dalah taraf pembekuan dan pencabutan izin usaha. Penelitian ini bertujuan untuk mengetahui bagaimana pengaturan dan bentuk perlindungan hukum data pribadi di Indonesia dan seberapa besar peran OJK sebagai Lembaga Independen untuk memberikan perlindungan dan pengawasan. Penelitian ini menggunakan metode penelitian yuridis normatif yang terdiri dari bahan hukum primer berupa perundang-undangan, bahan hukum sekunder berupa jurnal atau penelitian yang relevan, bahan hukum tersier berupa bahan non hukum yang relevan dengan penulisan ini. / Indonesia is a country that is open to the development of the times which is currently moving towards the digital era quite well. Along with the times, community activities will not be separated from the help of technology. Advances in information technology and financial innovation have created a highly complex, dynamic and interrelated financial system. In order for community activities to remain under supervision and protection, the Financial Services Authority (OJK) was formed as an independent state institution engaged in the financial sector. The role of the OJK in this case is to provide oversight to Financial Technology companies, especially online loan applications, which are currently abusing consumers' personal data when conducting online financial transactions. Personal data protection arrangements in Indonesia have been regulated through POJK regulation Number 10 of 2022. Companies Fintech is prohibited from misusing consumers' personal data, but this abuse of authority still occurs frequently, because the sanctions in these regulations are still at the level of freezing and revocation of business licenses. This study aims to find out how the regulation and form of legal protection for personal data in Indonesia and how big the role of OJK as an independent institution is to provide protection and supervision. This study uses a normative juridical research method consisting of primary legal material in the form of legislation, secondary legal material in the form of relevant journals or research, tertiary legal material in the form of non-legal material relevant to this writing.
