Abstract

Selain mengulas tentang ketentuan dan peraturan terkait pengupahan dan jam kerja, penelitian ini juga membahas kondisi pasar tenaga kerja di Indonesia serta hasil penelitian dari Jobstreet terkait dampak atas penerapan WFH bagi pekerja dan solusi perlindungan hukum yang tepat bagi system WFH atau remote working. Penelitian ini juga bertujuan untuk untuk menjelaskan dan menganalisis ketentuan mengenai pengaturan upah dan jam kerja dapat memberikan perlindungan hukum bagi pekerja yang bekerja dalam system WFH dan keluarganya beserta akibat hukumnya. Rumusan masalah yang digunakan dalam skripsi ini adalah bagaimana pengaturan pengupahan dan jam kerja menurut ketentuan peraturan perundang-undangan di Indonesia dan bagaimana perlindungan hukum bagi pekerja jika terjadi penyimpangan terhadap ketentuan pengupahan dan jam kerja di era Society 5.0. Penelitian ini merupakan penelitian hukum normative tipe penelitian library research (studi kepustakaan) dan juga dengan menggunakan metode penelitian yuridis normative dan menggunakan pendekatan peraturan perundang-undangan (statue approach), pendekatan konseptual (conseptual approach) dan pendekatan komparatif. Selain itu penelitian ini menggunakan bahan hukum primer yaitu KUHPerdata dan semua peraturan perundang-undangan tentang ketenagakerjaan yang masih berlaku, bahan hukum sekunder berupa buku teks, jurnal yang berkaitan dengan penelitian serta menggunakan bahan hukum tersier. Dari hasil penelitian ini disimpulkan bahwa Indonesia memerlukan sebuah undang-undang atau peraturan khusus yang mengatur tentang remote working untuk mengantisipasi WFH ini akan diberlakukan secara tetap meskipun pandemic sudah dikatakan berakhir. Sementara itu, perjanjian kerja, Peraturan Perusahan dan Perjanjian Kerja Bersama (PKB) merupakan mekanisme perlindungan hukum preventif. Kata Kunci : Perlindungan Hukum Bagi Pekerja Di Era Society 5.0 Atas Perubahan Pengaturan Pengupahan dan Jam Kerja. / In addition to reviewing the provisions and regulations related to wages and working hours, this research also discusses labour market conditions in Indonesia as well as research results from Jobstreet regarding the impact of implementing WFH for workers and appropriate legal protection solutions for WFH systems or remote working. This study also aims to explain and analyse the provisions regarding the regulation of wages and hours of work that can provide legal protection for workers working in the WFH system and their families and their legal consequences. The formulation of the problem used in this thesis is how to regulate wages and working hours according to the provisions of laws and regulations in Indonesia and how is the legal protection for workers in the event of deviations from the provisions of wages and working hours in the Society 5.0 era. This research is a normative legal research type of library research (library study) and also uses normative juridical research methods and uses statutory approaches, conceptual approaches and comparative approaches. In addition, this study uses primary legal materials, namely the Civil Code and all applicable labour laws and regulations, secondary legal materials in the form of textbooks, journals related to research and uses tertiary legal materials. From the results of this study, it was concluded that Indonesia needs a special law or regulation that regulates remote working to anticipate that WFH will be enforced permanently even though the pandemic has been said to be over. Meanwhile, work agreements, company regulations and collective labour agreements (PKB) are preventive legal protection mechanisms.
