Abstract

Di tengah kemudahan untuk investor asing yang diberikan oleh pemerintah Indonesia dalam membuka keran investasi asing, terdapat celah yang dimanfaatkan oleh beberapa oknum. Salah satu cela kemudahan tersebut dimanfaatkan pada fasilitas keimigrasian. Kemudahan bagi investor asing di sektor keimigrasian adalah dengan pemerolehan Izin Tinggal Terbatas (ITAS) Investor dengan jangka waktu 2 tahun. Dari kemudahan tersebut, terdapat beberapa orang yang melakukan penyalahgunaan izin tinggal berkedok investasi asing. Untuk itu, penelitian ini dilakukan guna menjawab rumusan masalah bagaimana strategi pemerintah Indonesia menghadapi ancaman migrasi internasional, melalui Kantor Imigrasi Jakarta Selatan dalam menindak penyalahgunaan izin tinggal berkedok investasi asing. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan studi kasus berdasarkan data primer dan sekunder. Telah ditemukan 22 kasus penyalahgunaan izin tinggal berkedok investasi yang terjadi di wilayah Jakarta Selatan dalam tiga tahun terakhir. Strategi pemerintah Indonesia untuk mengidentifikasi penyalahgunaan izin tinggal adalah dengan melakukan peningkatan pengawasan orang asing, sosialisasi untuk meningkatkan kesadaran masyarakat terhadap WNA, melakukan Operasi Gabungan dengan beberapa instansi. Untuk menghadapi kasus tersebut strategi yang dilakukan menggunakan kapasitas koersi berupa Tindakan Administrasi Keimigrasian (TAK) bagi para pelaku pelanggar keimigrasian. TAK yang dilakukan berupa deportasi dan pencantuman nama di dalam daftar cekal-tangkal keimigrasian. Upaya-upaya tersebut terbukti efektif menekan jumlah kasus penyalahgunaan Izin Tinggal yang terjadi. Dengan meningkatnya upaya identifikasi yang dilakukan, jumlah kasus penyalahgunaan yang dapat ditanggulangi juga meningkat. Kata Kunci: Penyalahgunaan Izin Tinggal; Investasi Asing; Tindakan Administratif Keimigrasian; Kebijakan Keimigrasian Selektif; Kapasitas Koersi. / In the midst of the convenience for foreign investors provided by the Indonesian government in opening foreign investment faucets, there are loopholes that are exploited by some individuals. One of these conveniences is utilized in immigration facilities. Convenience for foreign investors in the immigration sector is by obtaining a Temporary Stay Permit (ITAS) for Investors with a period of 2 years. From this convenience, there are several people who abuse their residence permits under the guise of foreign investment. For this reason, this research was conducted to answer the formulation of the problem on how the Indonesian government's strategy is to deal with the threat of international migration, through the South Jakarta Immigration Office in taking action against abuse of residence permits under the guise of foreign investment. The research method used is qualitative with a case study approach based on primary and secondary data. 22 cases of misuse of residence permits under the guise of investment have been found in the South Jakarta area in the last three years. The Indonesian government's strategy to identify abuse of residence permits is to increase supervision of foreigners, outreach to increase public awareness of foreigners, and to carry out Joint Operations with several agencies. To deal with this case, the strategy used to use coercive capacity is in the form of Immigration Administration Actions (IAA) for perpetrators of immigration offenders. The IAA that has been carried out is in the form of deportation and inclusion of names on the list of immigration bans. These efforts have proven to be effective in reducing the number of cases of abuse of residence permits that occur.
