Abstract

Kepastian hukum dalam perolehan hak atas tanah guna kegiatan penanaman modal di Indonesia, dalam implementasinya, tidaklah semudah sebagaimana ditegaskan dalam undang- undang penanaman modal dan peraturan organik lainnya, apalagi jika dikaitkan dengan peraturan daerah di negara Republik Indonesia ini. Penanam modal atau investor yang akan melakukan kegiatan menanamkan modalnya di atas tanah dalam wilayah hukum Republik Indonesia, baik penanam modal dalam negeri atau penanam modal asing, sudah barang tentu akan berimbas kepada peningkatan perekonomian di wilayah ditanamkannya modal tersebut, dan secara keseluruhan akan menjadi “peta kemajuan” perekonomian bangsa dan negara. Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal tidak mempunyai kekuatan hukum mengikat, dan Undang-undang Nomor 5 Tahun Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria telah melahirkan beberapa peraturan organiknya. Namun kedua peraturan ini, pada dasarnya sudah merupakan “payung hukum” yang memenuhi kriteria yang cukup bagi penanam modal atau invertor dalam perencanaan ber-investasi. Praktik para oknum pemerintah (termasuk aparat penegak hukum), baik ditingkat pusat maupun ditingkat daerah, seperti “under table” dan jatah hasil produksi pada kurun waktu tertentu atas sejumlah uang tertentu, sudah tidak menjadi sebuah rahasia lagi. Semua terbuka, walau praktiknya dengan menterahkan sejumlah uang tunai (cash) kepada para oknum pemerintah (aparat penegak hukum) tersebut. Hal inilah yang membuat para investor lebih cenderung menanamkan modalnya di luar wilayah Republik Indonesia. Dimasa yang akan datang, perlu diterbitkan sanksi hukum secara khusus atas sikap yang tidak terpuji dari para oknum pemerintah (termasuk aparat penegak hukum) tersebut, guna menanamkan kepercayaan nasional dan menarik kembali minat para investor dalam negeri atau investor asing. Dalam kajian atas sanksi hukum khusus dimaksud, maka perlu disepakati dan ditegaskan adanya kepastian (atas analisis tertentu) terhadap doktrin teori hukum yang ada. Kata kunci: Kepastian hukum hak atas tanah dalam hukum investasi. / Legal certainty regarding the acquisition of land for investment activities in Indonesia is not as straightforward in its implementation as emphasized in the investment laws and other organic regulations, especially when it is associated with local regulations in the Republic of Indonesia. Investors who intend to invest their capital in land within the jurisdiction of the Republic of Indonesia, whether domestic or foreign investors, will undoubtedly have an impact on the economic growth in the area where the investment is made, ultimately contributing to the overall economic progress of the nation. The Law Number 25 of 2007 on Investment does not have binding legal force, and the Law Number 4 of 1960 on Basic Agrarian Principles has given rise to several organic regulations. However, both of these regulations essentially serve as a legal framework that sufficiently fulfills the criteria for investors in investment planning. The practices of certain government officials (including law enforcement authorities) at both the central and regional levels, such as engaging in under-the-table transactions and receiving shares of production results for a certain period in exchange for a specific amount of money, are no longer a secret. These practices are open for all to see, although they often involve discreetly providing cash to government officials (law enforcement authorities). This situation has led investors to prefer investing their capital outside the territory of the Republic of Indonesia. In the future, it is necessary to establish specific legal sanctions against the unscrupulous behavior of these government officials (including law enforcement authorities) in order to restore national trust and attract the interest of domestic and foreign investors. In examining these proposed specific legal sanctions, it is important to agree upon and emphasize the certainty (based on certain analyses) of the existing legal doctrine theory.
