Abstract

Dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, bahwa Merek adalah tanda yang dapat ditampilkan secara grafis berupa gambar, logo, nama, kata, huruf, angka, susunan warna, dalam bentuk dua dimensi dan/atau tiga dimensi, suara, hologram, atau kombinasi dari dua atau lebih unsur tersebut untuk membedakan barang atau jasa yang diproduksi oleh orang atau badan hukum dalam kegiatan perdagangan barang atau jasa. Perlindungan merek asing terkenal secara internasional diatur dalam ketentuan Pasal 6 Konvensi Paris, bahwa secara ex officio diperbolehkannya peraturan perundang-undangan yang ada dalam masing-masing negara atau atas permintaan yang berkepentingan untuk menolak atau membatalkan pendaftaran suatu merek yang merupakan reproduksi imitasi, atau terjemahan belaka yang menimbulkan kekeliruan dari suatu merek terkenal di negara tersebut serta dipakai untuk barang-barang yang sama atau /sejenis. Putusan Mahkamah Agung Nomor 653 K/Pdt.Sus-HKI/2020 dan beberapa kasus merek lainnya, terhadap perlindungan merek asing di Indonesia. Telah terbukti, bahwa perlindungan hukum terhadap merek asing dan merek asing terkenal di Indonesia, masih sangat minim dan memerlukan waktu serta biaya yang tidak sedikit. Sehingga proses peradilan sampai tingkat Mahkamah Agung, sudah tidak dapat disebut lembaga peradilan yang menyelesaikan gugatan dengan asas sederhana, cepat dan biaya ringan terhadap sengketa merek asing terkenal. Sehingga di masa yang akan datang, diperlukan keseriusanyang sungguh dari pemerintah dan aparat hukum terkait atas penerapan Undang-Undang Merek yang berlaku di Indonesia . Kata Kunci : Perlindungan merek asing terkenal di Indonesia. / According to Law Number 20 of 2016 concerning Trademarks and Geographical Indications, a Mark is a sign that can be graphically displayed in the form of a picture, logo, name, word, letter, number, color scheme, in two-dimensional and/or three-dimensional form, sound, holograms, or a combination of two or more of these elements to distinguish goods or services produced by individuals or legal entities in the activity of trading goods or services. Protection of internationally recognized foreign marks is governed by the provisions of Article 6 of the Paris Convention, which ex officio permits statutory regulations that exist in each country or at the request of interested parties to reject or cancel the registration of a mark that is an imitation reproduction, a simple translation, or that causes confusion with a well-known brand in that country and is used for the same or/similar goods. Regarding the protection of foreign brands in Indonesia, the Supreme Court has ruled in various brand cases, including Case No. 653 K/Pdt.Sus-HKI/2020. It has been established that there is little legal protection for well-known foreign brands and foreign brands from other countries in Indonesia and that doing so costs a lot of time and money. In order for the legal system up to the Supreme Court to no longer be referred to as a judicial institution that settles legal disputes involving well-known foreign brands in a straightforward, quick, and inexpensive manner. So that in the future, the government and pertinent legal framework must take the application of the Indonesian Trademark Law seriously. Keywords: Indonesian protection of well-known foreign brands.
