Abstract

Keberadaan tenaga honorer pada instansi pemerintahan di Indonesia saat ini tidak jelas. Secara historis, dimulai dari adanya Peraturan Pemerintah Nomor 48 Tahun 2005 yang dalam salah satu pasalnya terdapat larangan dalam merekrut tenaga honorer, sampai dengan diterbitkannya Undang-Undang Nomor 5 Tahun 2014 yang hanya mengakui status tenaga honorer sebagai Pegawai Pemerintah dengan Perjanjian Kerja (PPPK). Saat ini juga terdapat bermacam-macam nomenklatur tenaga honorer di Indoneia. Lebih lanjut, pengaturan terkait Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) juga tidak diatur secara jelas. Tujuan dari penelitian ini adalah untuk mengetahui hubungan kerja bagi tenaga honorer pada instansi pemerintahan di Indonesia dan pengaturan serupa terkait ketentuan PKWT (Perjanjian Kerja Waktu Tertentu) dalam hukum ketenagakerjaan. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian menunjukkan bahwa hubungan hukum yang terjadi pada tenaga honorer telah mencakup unsur-unsur pekerjaan yaitu: perintah, pekerjaan, upah dan waktu (kondisi) yang harus dipenuhi dalam suatu hubungan kerja. Dikarenakan terdapat kekosongan hukum dalam pengaturan pelaksanaan ketentuan tenaga honorer bagi tenaga honorer pada instansi pemerintahan di Indonesia, maka pengaturannya dapat dilakukan dengan menggunakan kontrak biasa yang tunduk pada hukum privat /ketenagakerjaan atau membuat peraturan teknis yang mengatur secara rinci mengenai tenaga honorer pada instansi pemerintahan di Indonesia. Ketiadaan regulasi mengenai tenaga honorer menyebabkan sulitnya memberikan perlindungan bagi tenaga honorer dan berpotensi menimbulkan konflik di kemudian hari. Karenanya perlu dibuat aturan secara rinci agar tercipta keseragaman aturan tenaga honorer. Kata kunci: Tenaga Honorer, Hubungan kerja, Perjanjian kerja, Instansi Pemerintah. / The existence of non-staff employee in government institution in Indonesia is currently unclear. Historically, starting from the existence of Government Regulation No. 48 of 2005, which in one of its articles contained a ban on recruiting non-staff employee, until the issuance of Law No. 5 of 2014 which only recognizes the status of non-staff employee as Government Employees with Work Agreements (PPPK). Currently, there are also various nomenclatures of non-staff employee in Indonesia. In addition, the regulation related to Government Employees with Employment Agreements (PPPK) is also not clearly regulated. The purpose of this research is to find out the employment relationship for non-staff employee in government institution in Indonesia and similar arrangements related to the provisions of PKWT (Specified Time Work Agreement) in labor law. The research method used is normative juridical. The results show that the legal relationship that occurs in non-staff employee has included elements of work, namely: order, work, wage and time (condition) that must be fulfilled in an employment relationship. Due to the legal vacuum in regulating the implementation of non-staff employee provisions for non�staff employee in government institution in Indonesia, the regulation can be done by using ordinary contracts that are subject to private / labor law or making technical regulations that regulate in detail about non-staff employee in government institution in Indonesia. The absence of regulations regarding non-staff employee makes it difficult to provide protection for non-staff employee and has the potential to cause conflicts in the future. Therefore, it is necessary to make detailed rules in order to create uniformity of non-staff employee rules.
