Abstract

Pendaftaran merek digunakan untuk membedakan antara merek dagang dan merek jasa yang dimiliki oleh sebuah perusahaan, Dengan mendaftarkan merek, otomatis pengusaha mendapatkan hak ekslusif serta perlindungan hukum. Fungsi pendaftaran merek untuk menghindari adanya peniruan serta untuk mendapatkan perlindungan hukm atas merek. Permasalahan yang dibahas pada penelitian ini adalah bagaimana perlindungan hukum pemegang hak atas merek dan apakah putusan sudah sesuai dengan Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Metode penelitian yang digunakan terkait penelitian ini adalah penelituan hukum normatif (yuridis normatif) yang berdasarkan kepada norma perundang-undangan dan studi kasus putusan pengadilan. Pasal 1 angka 1 Undang-Undang Nomor 20 Tahun 2016 mendefinisikan merek sebagai tanda yang dapat ditampilkan secara grafis yang berupa logo, gambar, nama kata, huruf, angka, susunan warna. Merek yang sudah terdaftar akan memiliki jangka waktu perlindungan hukum selama 10 tahun berdasarkan Pasal 35 ayat (1) Undang-Undang Nomor 20 Tahun 2016. Merek yang terbukti meniru merek yang telah didaftarkan terlebih dahulu dapat dikenakan sanksi penghapusan atau pembatalan sesuai dengan Pasal 76 sampai 79 Undang-Undang Nomor 20 Tahun 2016. Sesuai ketentuan Pasal 21 ayat (1) Undang-Undang Nomor 20 Tahun 2016 mendefisinikan merek yang memiliki persamaan pada pokoknya yaitu merek yang mempunyai kemiripan yang disebabkan oleh adanya unsur dominan antara satu merek dengan merek lainnya, sehingga akan menimbulkan persamaan pada pokoknya yang dapat berupa susunan kata dan bunyi ucapan. Suatu penyelesaian sengketa dapat diselesaikan dengan dua cara, yaitu dengan mengajukan gugatan ke Pengadilan Niaga (Pasal 83 Undang-Undang Nomor 20 Tahun 2016), ataupun dapat diselesaikan melalui arbitrase atau alternatif penyelesaian sengketa. Sesuai dengan kasus sengketa merek antara Ps Glow dan Ms Glow, penyelesaian sengketa dilakukan dengan mengajukan gugatan ke Pengadilan Niaga. Kata Kunci : Perlindungan, Penyelesaian Sengketa. / Trademark registration is used to distinguish between trademarks and service marks owned by a company. By registering a mark, entrepreneurs automatically get exclusive rights and legal protection. The function of trademark registration is to avoid imitation and obtain legal protection for the mark. The problems discussed in this study are the legal protection of trademark rights holders and whether the decision is in accordance with Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The research method used in this research is normative legal research (normative juridical), which is based on statutory norms and case studies of court decisions. Article 1 point 1 of Law Number 20 of 2016 defines a mark as a sign that can be displayed graphically in the form of logos, images, word names, letters, numbers, and color arrangements. Marks that have been registered will have a legal protection period of 10 years based on Article 35, paragraph 1, of Law Number 20 of 2016. Marks that are proven to imitate brands that have been registered beforehand may be subject to sanctions for deletion or cancellation in accordance with Articles 76 to 79 of Law Number 20 of 2016. In accordance with the provisions of Article 21 paragraph (1) of Law Number 20 of 2016, brands that have similarities in essence are defined as those that have similarities caused by the presence of a dominant element between one brand and another, so that it will lead to similarities in essence, which can be in the form of word order and speech sounds. A dispute settlement can be resolved in two ways, namely by filing a lawsuit with the Commercial Court (Article 83 of Law Number 20 of 2016) or through arbitration or alternative dispute resolution. In accordance with the brand dispute case between Ps Glow and Ms Glow, the settlement of the dispute was carried out by filing a lawsuit with the Commercial Court.
