Abstract

Di Indonesia salah satu contoh kasus Influencer yang menggunakan jasa Endorse judi Online adalah Apriazi Sundana atau yang biasa disebut dengan username Instagram @Ubeyapsensso selaku Influencer atau Selebgram dengan jumlah followers 71,9 K atau 71.900 pengikut menerima Endorsement situs judi Online. Rumusan masalah dalam penelitian ini, yaitu: (1) Bagaimana Status dan kedudukan Influencer secara hukum? dan (2) Bagaimana penerapan hukum yang ditetapkan hakim terhadap Influencer dalam mengiklankankan judi Online sesuai dengan Putusan Nomor 907/Pid.Sus/2022/PN Plg?. Metode penelitian yang digunaikan adalah berbentuk yuridis normative atau penelitian kepustakaan dengan menggunakan sumber data sekunder.Adapun hasil dan pembahasan dari penelitian ini yaitu: UUPK menurut analisis ini tidaklah tepat untuk menjerat Influencer dalam melakukan Jasa Endorsement Judi Online serta tidak adanya status dan kedudukan hukum Influencer. status dan kedudukan Influencer dapat dilihat pada ketentuan Pasal 1 angka 18, Pasal 1 angka 19, Pasal 27 ayat (2) dan Pasal 45 ayat (1) UU ITE. Seorang Influencer memiliki status dan kedudukan hukum menurut KUHPerdata ketika melakukan perikatan yaitu antara Pihak Pelaku Usaha dan Pihak Influencer yang melakukan perikatan dan membuat perjanjian baik secara lisan maupun secara tulisan. Penerapan sanksi hukum melalui Putusan Pengadilan dengan Nomor Register Perkara: 907/Pid.Sus/2022/PN PLG pada hari Selasa, 02 Agustus 2022 sudah cukup baik, namun disisi lain penulis tidak menemukan adanya Kepastian Hukum terhadap Pelaku Usaha yang Perjudian Online yang sebenarnya merupakan akar dari kejahatan Perjudian Online ini. Kepada pemerintah agar segera melakukan perubahan atau pembaharuan terkait tanggung jawab pelaku usaha perjudian Online, hal ini dikarenakan apabila dilihat melalui UU Perlindungan Konsumen juga tidak terdapat tanggung jawab Pelaku Usaha yang melakukan penyebarluasan Perjudian Online. Kata Kunci: Influencer, Endorsement. / In Indonesia, one example of an Influencer case that uses Online gambling Endorsement services is Apriazi Sundana or commonly known as the Instagram username @Ubeyapsensso as an Influencer or Selrbgram with a total of 71.9 K followers or 71,900 followers receiving Endorsements from Online gambling sites. The formulation of the problem in this study, namely: (1) What is the legal status and position of Influencers? and (2) How is the application of the law determined by the judge against Influencers in advertising Online gambling in accordance with Decision Number 907/Pid.Sus/2022/PN Plg?. The research method used is in the form of normative juridical or literature research using secondary data sources. The results and discussion of this study are: UUPK according to this analysis is not appropriate to ensnare Influencers in carrying out Online gambling Endorsement services and there is no status and legal standing of Influencers. The Influencer's status and position can be seen in the provisions of Article 1 point 18, Article 1 number 19, Article 27 paragraph (2) and Article 45 paragraph (1) of the ITE Law. An Influencer has legal status and standing according to the Civil Code when conducting an engagement, namely between the Business Actor and the Influencer Party who carries out the engagement and makes an agreement both orally and in writing. The application of legal sanctions through a Court Decision with Case Register Number: 907/Pid.Sus/2022/PN PLG on Tuesday, 02 August 2022 is quite good, but on the other hand the author does not find any Legal Certainty for Business Actors whose Online Gambling is actually the root of this Online gambling crime. To the government to immediately make changes or updates related to the responsibilities of Online gambling business actors, this is because when viewed through the Consumer Protection Act there is also no responsibility for Business Actors who disseminate Online Gambling.
