Abstract

Indonesia merupakan negara yang terdiri dari berbagai macam budaya dan agama. Namun, keberagaman kehidupan beragama di Indonesia sering terjadi konflik horizontal. Hal ini disebabkan oleh tidak tegasnya Pemerintah pusat dan Pemerintah daerah dalam menangani konflik beragama. Selain itu adanya regulasi rumah ibadat yang terkesan diskriminatif khususnya bagi kaum minoritas. Sejak pemberlakuan Peraturan Bersama Menteri nomor 8 dan 9 tahun 2006 yang mengatur regulasi rumah ibadat secara khusus seringkali minoritas kesulitan dalam proses perizinan dan pembangunan rumah ibadat. Penelitian ini dilakukan melalui studi pustaka dengan melihat berbagai contoh kasus di lapangan yang pada umumnya merugikan kaum minoritas Peraturan Bersama Menteri memiliki kekuatan yang kurang mengikat secara hukum dibanding dengan Undang - Undang. Sudah banyak pihak yang menganggap peraturan ini diskriminatif terlebih bagi kaum minoritas namun belum ada tanda – tanda Pemerintah akan bertindak terkait Peraturan Bersama Menteri ini akan dicabut ataupun revisi bahkan dibuatkan dalam Undang- Undang./ Indonesia is a country that consists of various cultures and religions. However, the diversity of religious life in Indonesia often results in horizontal conflicts. This is caused by the indecisiveness of the central government and regional governments in dealing with religious conflicts. In addition, the existence of regulations on houses of worship that seems discriminatory,especially,for,minorities. Since the enactment of the Joint Ministerial Regulations number 8 and 9 of 2006 which specifically regulate the synagogue regulations, often the minority has difficulties in the process of licensing and construction of houses of worship. This research was conducted through a literature study by looking at various examples of cases in the field which generally,disadvantage,minorities Joint Ministerial Regulations have less legally binding force than the Law. There have been many parties who consider this regulation discriminatory especially for minorities but there are no signs that the Government will act in conjunction with this Ministerial Joint Regulation which will be revoked or even revised in the Law.
