Abstract

Pembahasan dalam skripsi ini adalah pelaksanaan lelang eksekusi hak tanggungan atas harta pailit yang dilakukan oleh kreditor separatis sebagai pemegang hak jaminan tersebut. Sebagaimana disebutkan di dalam Undang – Undang Kepailitan bahwa kreditor pemegang hak tanggungan atas harta pailit dapat melaksanakan haknya seolah – olah tidak terjadi kepailitan. Hak tersebut dapat dilakukan pada masa insolvensi dengan jangka waktu selama 60 (enam puluh hari) dengan studi kasus PT The First National Glassware (Dalam Pailit). Penelitian ini adalah penelitian yuridis normatif dengan tipologi penelitian dreskriptif. Pokok permasalahan dalam penelitian ini adalah bagaimana prosedur dan persyaratan lelang eksekusi hak tanggungan harta pailit pada Kantor Pelayanan Kekayaan Negara dan Lelang dan apakah pelaksanaan lelang eksekusi hak tanggungan atas harta pailit PT The First National Glassware yang diajukan oleh PT Bank ICBC Indonesia telah sesuai dengan ketentuan hukum yang berlaku. Peneliti memperoleh kesimpulan bahwa pada lelang eksekusi hak tanggungan harta pailit ada tiga tahap yang harus dijalankan, yaitu tahap pralelang, tahap pelaksanaan lelang, dan tahap pasca lelang. Permohonan lelang eksekusi hak tanggungan yang diajukan oleh PT Bank ICBC Indonesia diterima oleh KPKNL setelah melengkapi semua persyaratan yang ditentukan oleh peraturan pelaksanaan lelang eksekusi Hak Tanggungan. Lelang eksekusi hak tanggungan dilaksanakan pada tanggal 12 Juli 2019 akan tetapi tidak ada peminatnya sehingga lelang dinyatakan Lelang TAP oleh Pejabat lelang dengan diterbitkan Risalah Lelang. Setelah masa insolvensi berakhir, pemberesan boedel harta pailit beralih kepada Kurator sebagaimana diatur di dalam Undang - Undang Kepailitan./ The discussion in this thesis is the implementation of mortgage auction of bankruptcy property done by secured creditors as the holder of the guarantee right. As is mentioned in the Law of Bankcruptcy that creditors holding mortgage right of bankcruptcy property may exercise their right as if there is no bankcruptcy. Such right can be done during the insolvency term in the period of 60 (sixty) days with the case study of PT The First National Glassware (in bankcruptcy). This research is a juridical normative research with descriptive research typology. The main issues of the research are the procedures and requirements for the mortgage auction of bankcruptcy property at the Office of State Assets and Auction Services and whether the implementation of mortgage auction of bankcruptcy property belonging to PT The First National Glassware submitted by PT Bank ICBC Indonesia is done according to the provisions of the applicable law. The researcher gains the conclusion that there are three steps to the mortgage auction of bankcruptcy property, which are pre-auction, implementation of auction, and post-auction. The application for the mortgage auction submitted by PT Bank ICBC Indonesia was approved by the Office of State Assets and Auction Services after all requirements set forth by the applicable law were met. Then the mortgage auction was held on July 12th 2019. However there was no person interested, thus the auction was declared an auction with no person interested (Lelang TAP) by an auction official with the publication of Auction Records. After the insolvency term ends, the settlement of the bankcruptcy property boedel shifts to the Trustee as is regulated in the Law of Bankcruptcy.
