Abstract

Perlindungan hukum bagi konsumen merupakan hal yang sangat penting, karena pada dasarnya konsumen memiliki hak yang sama dengan pelaku usah baik itu hak yang bersifat universal maupun spesifik. Kurangnya pengetahuan dan pemahaman konsumen terhadap hak-hak sebagai konsumen dan pelaku usaha yang membuat kesalahan, membuat kedudukan konsumen lebih rendah dari pada pelaku usaha. Hal ini tidak terlepas dari adanya masalah yang dilakukan oleh pelaku usaha dalam memproduksi makanan kadaluarsa yang didaur ulang. Dimana konsumen berhak mendapatkan hak-haknya, baik secara moral maupun ekonomi. Metode yang digunakan dalam penelitian ini adalah penelitian dengan metode pendekatan yuridis normatif, yaitu dengan menelaah dan mengkaji ketentuan-ketentuan perundangundangan, terutama UUPK, dan peraturan lain yang berhubungan dengan masalah peredaran daur ulang produk pangan yang sudah kadaluarsa. Peredaran daur ulang makanan sangat merugikan baik ditinjau dari aspek kesehata maupun ekonomi. Sehubungan dengan itu perlu adanya sanksi hukum yang tegas terhadap pelaku usaha yang melakukan pelagaran daur ulang makanan kadaluarsa. Saaksi hukum tersebut dimaksudkan untuk melindungi konsumen agar kerugian dat di cegah atau ditekan seoptimal mungkin./ Legal protection for consumers is very important, because basically consumers have the same rights as business actors, both universal and specific rights. Lack of knowledge and understanding of consumers about the rights as consumers and business people who make mistakes, making consumers inferior to the business actors. This is inseparable from the problems done by businesses in producing expired food that is recycled. Where consumers are entitled to get their rights, both morally and economically. The method used in this study is a research with a normative juridical approach, namely by examining and reviewing the provisions of the legislation, especially the UUPK, and other regulations relating to the circulation of food products that have expired. Circulation of food recycling is very detrimental both in terms of health and economic aspects. In connection with this, it is necessary to have strict legal sanctions against business actors that carry out the expropriation of expired food recycling. The legal testimony is intended to protect consumers so that data loss is prevented or suppressed to the maximum extent possible
