Abstract

Perjudian merupakan salah satu penyakit masyarkat yang perlu dicegah dan ditanggulangi karena dalam dampak dari pelaksanaanya adalah terganggunya ketertiban masyarakat sebagai aparat negara yang menjalankan fungsi penegakan hukum,pemeliharaan keamanan dan ketertiban masyarakat serta perlindungan,pengayoman dan pelayanan masyarkat. Polisi bertugas untuk mencegah dan menanggulangi tindak pidana perjudian tersebut. Yang menjadi permasalahan dalam skripsi ini adalah bagaimana penegakan hukum oleh kepolisian terhadap pelaku tindak pidana perjudian dana pa yang menjadi faktor penghambat kepolisian dalam melakukan penegakan hukum terhadap pelaku tindak pidana perjudian. Metode penelitian dalam skripsi ini adalah yuridis sosiologis, untuk mengkaji dan membahas permasalahan-permasalahan yang dikemukakan, yaitu mengkaitkan hukum kepada usaha untuk mencapai tujuan-tujuan serta memenuhi kebutuhan-kebutuhan konkrit dalam masyarakat. Pendekatan ini dilakukan dengan cara mencari dan meneliti upaya yang dilakukan aparat kepolisian dalam menanggulangi tindak pidana perjudian dalam masyarakat. Dalam hukum positif yang berlaku di Indonesia,baik yang diatur dalam KUHP maupun yang diatur diluar KUHP seperti dalam UU No.7 Tahun 1974 tentang Penertiban Perjudian dan PP No.9 tahun 1981 tentang pelaksanaan UU No.7 Tahun 1974,kesemuanya menetapkan perjudian sebagai kejahatan sehingga praktiknya perlu dicegah dan ditanggulangi./ Gambling is a community disease that needs to be prevented and addresses because in its implementation the impact is disruption of public order as a state apparatus that carries out the functions of law enforcement, maintenance of security and public order as well as protection, protection and community service. The police are taskedwith preventing and overcoming the crime of gambling. The problem in this thesis is how to enforce law enforcement by police against gambling offenders and what constitutes a deterrent faktor in the police in enforcing law against perpetrators of gambling crimes. The research method in this theis is juridical sociology, to examine and discuss the problems raised, namely linking the law to efforts to achieve goals and fulfill concrete needs in society. This approach is carried out by searching and examining the efforts made by the police in tackling the crime of gambling in the community. In the positive law that applies in Indonesia, both those regulated outside the Criminal Code and those regulated outside the Criminal Code as in Law No.7 of 1974 concerning gambling control and PP no.9 of 1981 concerning the implementation of Law No.7 of 1974, all of which stipulate gambling as a crime so the practice needs to be prevented and addresses.
