Abstract

Era 5.0 beragam jenis investasi muncul salah satunya trading forex. Investasi illegal pada trading forex ini dilakukan oleh pialang berjangka tidak berizin usaha dari lembaga pengawas. Investasi illegal pada trading forex sangat merugikan masyarakat. Rumusan masalah skripsi ini ialah bagaimana regulasi terhadap investasi illegal dalam trading forex yang dilakukan oleh Pialang berjangka, dan bagaimana penerapan hukum oleh hakim atas investasi illegal pada trading forex yang dilakukan oleh Pialang Berjangka pada Putusan No. 107/Pid.B/2021/PN.SBY. Penelitian ini merupakan penelitian hukum yuridis normatif dengan pendekatan kasus. Jenis data ialah data sekunder dengan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang tersusun dalam penelitian ini. Hasil penelitian ini disimpulkan jika regulasi yang dapat diterapkan terhadap investasi illegal pada trading Forex diatur dalam Pasal 71 ayat 1 dan 2 serta Pasal 57 UU Perdagangan Berjangka Komoditi, Pasal 3 TPPU, Pasal 4 TPPU, Pasal 5 TPPU terhadap pencucian uang dalam trading forex, Pasal 46 UU Perbankan dalam penghimpunan dana. Penerapan hukum hakim pada Putusan No. 107/PID.B/2020/PN.SBY tidak memberikan kepastian hukum karena hanya diterapkan Pasal 378 tentang Penipuan. Upaya memberi kepastian hukum terhadap investasi illegal forex trading ialah membuat regulasi yang lebih mengatur secara khusus dan diharapkan penegak hukum aktif dalam memberi penerapan hukum. Kata Kunci: Cyber Crime, Phising, Carding, Kartu Kredit. / In the 5.0, various typesof investment appeared one of which was forex trading, Unlicensed futures brokers from regulatory egencies carry out this illegal investment oni forex trading. Illegal investment in forex trading are very detrimental to society. The formulation of the problem in this thesis is how to regulate illegal investments in forex trading by futures brokers and how the law is applied by judges to illegal investments in forex trading by futures brokers in Decision No.107/Pid.B/2021/PN.SBY. This research is a normative jurdicial law research with a case approach, secondary legal materials and tertiary legal materials arranged in this study. The results of this study concluded that if the regulations that can be applied to illegal investments in Forex trading are regulated in Article 71, paragraps 1 and 2 and Article 57 of the Commodity Futures Trading Law, Article 3 TPPU, Article 4 TPPU, Article 5 TPPU against money laundering in forex trading, Article 46 of the Banking Law in raising funds. Application of judge’s law in Decision No. 107/PIB.B/2020/PN.SBY does not provide legal certainly because it only applies Article 378 concerning Fraud. Efforts to provide legal certainly for illegal forex trading investments are to make more specific regulations.It is hoped that law enforces will be active in providing law enforcement.
