Abstract

Bahan tambahan pangan adalah kombinasi bahan baku pangan yang ditambahkan ke dalam pangan untuk meningkatkan mutunya. Penggunaan bahan tambahan pangan seperti formalin masih banyak ditemukan pada produk pangan, khususnya pada tahu. Hal tersebut dikarenakan konsumen memiliki kemampuan yang terbatas dalam menilai kualitas makanan. Penulis membahas penggunaan bahan tambahan pangan berbahaya formalin pada produk pangan tahu melalui Putusan Pengadilan Nomor 165/Pid.Sus/2020/PN Plg. Rumusan masalah dalam skripsi ini adalah bagaimana interpretasi hukum mengenai definisi pangan yang melampaui ambang batas maksimal dengan definisi pangan yang mengandung bahan yang berbahaya (formalin) pada produk pangan (tahu) dalam Putusan Nomor 165/Pid.Sus/2020/PN Plg dan Apakah hakim dalam penerapan hukumnya telah menggunakan dasar hukum yang sesuai dengan Undang-Undang Nomor 18 Tahun 2012 tentang Pangan dalam Putusan Nomor 165/Pid.Sus/2020/ PN Plg. Penelitian ini merupakan penelitian yuridis normatif yang menggunakan data sekunder berupa bahan hukum primer yang terdiri dari beberapa undang-undang dan Putusan Nomor 165/Pid.Sus/2020/PN Plg, serta bahan hukum sekunder berupa buku-buku, jurnal, dan karya tulis ilmiah lainnya yang berkaitan dengan bahan tambahan pangan berbahaya formalin, serta bahan hukum tersier berupa kamus, kemudian bahan hukum yang terkumpul disusun dan dianalisis. Kesimpulan penulis dalam penelitian ini yaitu Hakim dalam Putusan Nomor 165/Pid.Sus/PN Plg dinilai kurang menguraikan secara terperinci karena hakim hanya menyimpulkan tanpa membuat latar belakang pemikiran yang memuat alasan-alasan mengapa hakim berpendapat seperti yang didakwakan, sehingga penerapan hukum hakim dalam Putusan Nomor 165/Pid.Sus/2020/PN Plg secara normatif belum tepat karena hakim memiliki keterbatasan pengetahuan mengenai hakikat formalin. Kata Kunci : Bahan Tambahan Pangan, Bahan Berbahaya, Formalin, Tahu. / Food additives are a combination of food raw materials added to food to improve its quality. The use of food additives such as formalin is still widely found in food products, especially in tofu. This is because consumers have limited ability to assess food quality. So the authors are interested in discussing the use of dangerous food additives formaldehyde in tofu food products through the Decision Court Number 165/Pid.Sus/2020/PN Plg. The formulation of the problem in this thesis is how the legal interpretation of the definition of food that exceeds the maximum threshold with the definition of food containing harmful ingredients (formalin) in food products (tofu) in Decision Number 165/Pid.Sus/2020/PN Plg and whether the judge in the application of the law has used the legal basis in accordance with Law Number 18 of 2012 concerning Food in Decision Number 165/Pid.Sus/2020/PN Plg. This research is a normative juridical research that used is secondary data in the form of primary legal materials consisting of several laws and Decision Number 165/Pid.Sus/2020/PN Plg, as well as secondary legal materials in the form of books, journals, and other scientific papers related to hazardous food additives formalin, as well as tertiary legal materials in the form of dictionaries, then the collected legal materials are compiled and analyzed. The author's conclusion in this study is that the judge in Decision Number 165/Pid.Sus/PN Plg is considered not to elaborate in detail because the judge only concludes without making a background of thought that contains the reasons why the judge is of the opinion as charged, so that the application of the judge's law in Decision Number 165/Pid.Sus/2020/PN Plg is normatively incorrect because the judge has limited knowledge about the nature of formaldehyde.
