Abstract

Perkembangan zaman dan teknologi sangat berdampak ke berbagai aspek kehidupan, salah satunya dalam melakukan pemasaran produk dalam media digital, melalui perjanjian yang mengikat antara penyedia jasa periklanan yaitu Google Adsense yang bekerjasama dengan Youtube dengan pemilik akun situs web. Bentuk perjanjian yang mengikat para pihak perlu sesuai dengan syarat sahnya suatu perjanjian menurut Kitab Undang-Undang Hukum Perdata, namun dalam perkembangan bentuk perjanjian banyak yang tidak memenuhi persayaratan sahnya suatu perjanjian. Rumusan masalah dalam skripsi ini adalah bagaimana bentuk perjanjian Google Adsense serta mekanismenya di Youtube dan bagaimana penyelesaian sengketa terhadap pelanggaran klausula baku Google Adsense ditinjau dari Hukum Perlindungan Konsumen. Metode penelitian yang digunakan adalah metode penelitian Yuridis Normatif dengan pendekatan kepustakaan. Data yang digunakan berupa bahan hukum primer yakni Kitab Undang-Undang Hukum Perdata dan Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen dan beberapa literatur lain. Hasil penelitian menunjukan perjanjian antara Google Adsense dan Youtube dengan pemilik akun termasuk dalam bentuk perjanjian baku, jika sudah disepakati oleh penyedia jasa dengan konsumen maka perjanjian tersebut mengikat, oleh karena itu jika timbul sebuah sengketa dalam pelaksanannya maka akan diselesaikan sesuai dengan ketentuan dalam isi perjanjian tersebut. Diharapkan kedepan pemerintah membuat peraturan khusus peraturan terkait perjanjian baku secara elektronik Kata Kunci: Perjanjian Baku, Google Adsense, Youtube, Hukum Perlindungan Konsumen./ The development of an era and technology has greatly impacted various aspects of life, which one is marketing products in digital media, through binding agreements between advertising service providers, Google Adsense, in collaboration with Youtube and website account owners. The form of a contract that binds the parties needs to be under the legal requirements of an agreement according to the Indonesian Civil Code, through time many forms of agreement don’t fulfill the legal requirements of a contract. The formulation of the problem in this thesis is how the Google Adsense agreement forms and the mechanism on Youtube and how to resolve disputes against violations of Google Adsense standard clauses in terms of the Consumer Protection Law. The research method used is a normative juridical research method with a literature approach. The data is in the form of primary legal materials, such as the Indonesian Civil Code and Law No. 8 in 1999 about Consumer Protection and some other literature. The results of the study showed that the agreement between Google Adsense and Youtube with the account owner is included in the form of a standard contract, if it has been agreed upon by the service provider with the consumer, the agreement is binding, therefore if a dispute arises in its implementation it will be resolved under the provisions in the contents of the agreement. It is hoped that in the future the government will make special regulations related to the standard contract made by the digital medium.
