Abstract

The mass media reports about the arrest of suspected corruptors almost daily. They presented state officials and turned them into media commodities to gain profits through advertising and to obtain ratings. The rise of corruption cases raised by the media shows that the anti-corruption system has not been able to prevent the perpetrators of corruption. It is questionable to optimize the anti-corruption policy. It seems that there is no fear of the threat of punishment. Criminal threats against corruptors have not been optimal in achieving the goal of punishment, and corruption is even more rampant. The problem examined is the role of the media in reporting the optimization of the anti-corruption system in Indonesia. The purpose of this study is to criticize and explore the optimization of the anti-corruption system in Indonesia from the aspects of communication of law and politics of criminal law. This study uses the normative legal research method of the normwissenschaft which refers to the ius constituent with descriptive research specifications based on a critical paradigm. This research uses qualitative method. The results showed that the anti-corruption system was not optimal in preventing and eradicating corruption from the legal system theory. There was no integration between the legal substance, legal structure, and legal culture towards corruption through material criminal law, formal criminal law, and criminal implementation law. Therefore it is recommended the use of criminal law and political communication to improve the optimal anti-corruption system in Indonesia Keywords: Optimization, Legal Communication, Penal Policy
