Abstract

Demokrasi merupakan sistem pemerintahan yang menjamin hak-hak setiap masyarakat dalam menyalurkan hak suara pada pemilihan Kepala Daerah (Pilkada). Dalam penyelenggaraan Pilkada tersebut tentunya pihak KPU dan Bawaslu terlibat untuk menyelenggarakan dan mengawasi pemilihan umum. Pada pelaksanaan pilkada terkadang masih terdapatnya pelanggaran sehingga bisa memicu adanya hambatan-hambatan pada sistem demokrasi. Misalnya pada saat pelaksanaan pilkada Kabupaten Nias Selatan 9 Desember 2020, masih terdapatnya masalah dari dua aktor penting dalam pemilu yaitu KPU dan Bawaslu Kabupaten Nias Selatan. Masalah yang mendasari ialah adanya perbedaan pendapat antara KPU dan Bawaslu Kabupaten Nias Selatan yang di awali ketika adanya laporan salah satu masyarakat Kabupaten Nias Selatan yang menyatakan bahwa pasangan calon nomor urut 1 melakukan pelanggaran yang bersifat TSM (terstruktur, Sistematis dan Masif). Penelitian ini bertujuan untuk pertama, mengetahui menggapa Bawaslu mengeluarkan rekomendasi diskualifikasi terhadap KPU. Kedua, mengetahui menggapa KPU menolak rekomendasi diskualifikasi oleh Bawaslu. Ketiga, untuk mengetahui solusi dari perselisihan antara kedua belah pihak dari hasil pemilihan. Metode penelitian yang di gunakan adalah metode penelitian kualitatif, desain peneletian exploratif, mengumpulkan data yang bersifat primer dan sekunder. Teori yang di gunakan adalah teori menurut Robert Alan Dahl, Teori menurut Henry B. Mayo dan juga teori menurut Miriam Budiardjo. Hasil penelitian ini adalah pertama, Bawaslu memberikan rekomendasi diskualifikasi terhadap paslon 1 (satu) karena berdasarkan laporan yang di terima oleh Bawaslu dari masyarakat atas dugaan pelanggaran penyalahgunaan kewenangan. Kedua, KPU menolak rekomendasi Bawaslu karena berdasarkan pada PKPU Nomor 25 Tahun 2013 , KPU melakukan tindaklanjut dan dengan hasil tidak sesuai bukti diskualifikasi yang rekomendasikan oleh Bawaslu. Ketiga, berdasarkan pernyataan KPU dan Bawaslu dalam persidangan DKPP RI maka hasilnya adalah terdapat adanya pelanggaran yang di lakukan oleh Bawaslu ketika merekomendasikan diskualifikasi pasangan calon nomor 1 kepada KPU. Sehingga keputusan yang di keluarkan KPU sejak awal sudah sesuai dengan PKPU 25 Tahun 2013./ Democracy is a government system that guarantees the rights of every community in distributing voting rights in the Regional Head Election (Pilkada). In organizing the Pilkada, of course, the KPU and Bawaslu are involved in organizing and supervising the general electionIn the implementation of regional elections, sometimes there are still violations that can trigger obstacles in the democratic system. For example, during the election of South Nias Regency on December 9, 2020, there were still problems from two important actors in the election, namely KPU and Bawaslu of South Nias Regency. The underlying problem is that there is a difference of opinion between the KPU and the Bawaslu of South Nias Regency which began when there was a report by one of the people of South Nias Regency stating that the candidate pair number 1 committed a TSM (structured, systematic and massive) violation. This study aims, firstly, to find out why Bawaslu issued a disqualification recommendation to the KPU. Second, knowing why the KPU rejected the recommendation for disqualification by Bawaslu. Third, to find out the solution to the dispute between the two parties from the election results. The research method used is qualitative research methods, exploratory research design, collecting primary and secondary data. The theory used is the theory according to Robert Alan Dahl, the theory according to Henry B. Mayo and also the theory according to Miriam Budiardjo. The results of this study are first, Bawaslu provides a recommendation for the disqualification of candidate pair 1 (one) because it is based on a report received by Bawaslu from the community for alleged violations of abuse of authority. Second, the KPU rejected the Bawaslu recommendation because based on PKPU Number 25 of 2013, the KPU followed up and the results did not match the disqualification evidence recommended by Bawaslu. Third, based on the KPU and Bawaslu statements in the DKPP RI trial, the result was that there were violations committed by Bawaslu when recommending the disqualification of candidate pair number 1 to the KPU. So that the decision issued by the KPU from the start was in accordance with PKPU 25 of 2013.
