Abstract

Arbitrase merupakan cara penyelesaian sengketa komersial atau bisnis yang efektif, dibandingkan melalui litigasi di pengadilan mengingat efektivitas putusan arbitrase yang ,waktu cepat dan biaya lebih murah, kerahasiaan terjaga, keputusan cepat, fleksibel dan bebas memilih arbiternya serta sifat putusan arbitrase final dan mengikat. Namun, kenyataan putusan arbitrase yang tidak dapat dijalankan eksekusi sepenuhnya dan permohonan eksekusi arbitrase mendapatkan penolakan untuk putusan arbitrase asing di Indonesia membuat putusan arbitase tidak berarti sama sekali. Dalam penulisan skripsi ini, penulis menggunakan metode penelitian Yuridis Normatif, sedangkan jenis data yang digunakan penulis adalah data sekunder (kepustakaan) dan data primer yaitu bahan hukum yang bersifat autoritatif, yakni bahan hukum yang mempunyai otoritas. Penulisan Skripsi bertujuan untuk memahami kewenangan pengadilan di Indonesia dalam pertimbangan hakim yang menjadi dasar penolakan putusan arbitrase di dalam kasus sengketa arbitrase antara Astro Group dan Lippo Group Dalam kasus tersebut Pengadilan negeri Jakarta pusat menolak eksekusi putusan arbitrase./Arbitration is an effective way of resolving commercial or business disputes, compared to litigation in court considering the effectiveness of arbitral awards, fast time and cheaper costs, confidentiality is maintained, decisions are fast, flexible and free to choose the arbitrator and the nature of the arbitration award is final and binding. However, the fact that the arbitral award cannot be fully executed and the application for arbitration execution has been rejected for a foreign arbitral award in Indonesia makes the arbitration award meaningless at all. In writing this thesis, the author uses a normative juridical research method, while the type of data used by the author is secondary data (library) and primary data, namely legal materials that are authoritative, namely legal materials that have authority. The purpose of writing the thesis is to understand the authority of the courts in Indonesia in the judge's consideration which is the basis for rejecting the arbitration award in the arbitration dispute case between Astro Group and Lippo Group. rejected the decision handed down at the Central Jakarta District Court.
