Abstract

Nama : Julianus Elia P Lawalata NIM : 1740050038 Judul : Tinjauan Yuridis Tentang Pemilihan Gubernur, Bupati, dan Walikota Di Tengah Pandemi COVID- 19 Kata Kunci : pilkada serentak, COVID-19, hukum tata negara. Dosen Pembimbing : 1) Poltak Siringoringo, S.H., M.H. 2) Dr. Yuni Artha Manalu, S.H., M.H. Penelitian dalam skripsi ini didasari oleh terjadinya pro-kontra di tengah masyarakat terkait dengan penyelenggaraan pilkada serentak tahun 2020 yang diselenggarakan di tengah pandemi COVID-19. Terdapat berbagai hambatan lain dalam penyelenggaraan pilkada serentak 2020. Tata cara tahapan-tahapan sebelum hari pemungutan suara juga banyak mengalami perubahan dibanding pilkada sebelumnya. Penelitian yang digunakan adalah penelitian yuridis normatif. Penelitian ini dilakukan lewat studi kepustakaan dimana bahan untuk penelitian diambil dari bahan bacaan yang memberikan gambaran umum serta pengetahuan tentang topik yang dibahas. Hasil dari penelitian yang telah dilakukan adalah COVID-19 memang merupakan tantangan utama pada penyelenggaraan pilkada tahun 2020 ini, namun COVID-19 juga merupakan alasan yang mendukung penyelenggaraan pilkada serentak 2020 karena diperlukannya pejabat definitif pada posisi kepala daerah bukan hanya pejabat sementara yang ditunjuk oleh pemerintah pusat karena perbedaan kewenangan yang cukup besar sehingga dapat menghambat lebih jauh penanganan serta penanggulangan COVID-19. Meskipun terdapat berbagai hambatan seperti perubahan cara kampanye, banyaknya aturan baru yang timbul, serta sosialisasi yang harus dilakukan kepada masyarakat merupakan tantangan tersendiri bukan hanya bagi penyelenggara namun juga pengawas, peserta, dan pemilih./ The research in this essay is based on the pros and cons in the society related to the simultaneous regional elections in 2020 which will be held in the midst of the COVID-19 pandemic. There are various other obstacles in holding the 2020 simultaneous regional elections. The procedures for the stages before the voting day have also undergone many changes compared to the previous regional elections. The research used is normative juridical research. This research was conducted through literature study where the material for research was taken from reading materials that provided an overview and knowledge of the topics discussed. The results of the research that have been carried out are that COVID-19 is indeed the main challenge in the implementation of the 2020 elections, but COVID-19 is also the reason that supports the holding of the 2020 simultaneous regional elections because a definitive official is needed in the position of regional head, not just a temporary official appointed by the government. central government because of the considerable difference in authority so that it can further hinder the handling and handling of COVID-19. Even though there were various obstacles such as changes in the way the campaign was carried out, the number of new rules that had emerged, and the socialization that had to be carried out to the public were challenges not only for organizers but also for supervisors, participants and voters.
