Abstract

A. Nama Mahasiswa : Febriantina B. Nomor Induk Mahasiswa : 1740050052 C. Judul Skripsi : Perlindungan pekerja/buruh yang mengalami pemutusan hubungan kerja saat pandemi Covid - 19 D. Kata Kunci : pemutusan hubungan kerja, covid-19 E. Program Kekhususan : Hukum Administrasi Negara F. Daftar Bacaan : undang – undang, Buku, Jurnal, Internet G. Jumlah Halaman : XII + 93 Halaman H. Ringkasan Isi Dengan adanya pandemi covid – 19 banyak sekali perusahaan yang terkena dari dampak ekonomi pandemi covid – 19 ini, hal ini mengakibatkannya terjadinya pemutusan hubungan kerja terhadap pekerja/buruh mencapai 3.05 juta yang disampaikan oleh Pemerintah. Sehingga masalah tersebut menimbulkan suatu peristiwa hukum salah satunya adalah perlindungan hukum terhadap pekerja/buruh yang terkena pemutusan hubungan kerja saat pandemi covid-19 Metedeologi penelitian yang dilakukan adalah penelitian hukum normatif dengan pendekatan perundang – undangan dan pendekatan kasus yang diambil dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier Berdasarkan hasil penelitian wabah pandemic covid – 19 ini diatur dalam perpres no . 12 tahun 2020 bahwa keadaan pandemic covid – 19 ini dapat digolongkan sebagai bencana non – alam. Jadi dalam hal ini pekerja yang terkena pemutusan hubungan kerja tidak sah jika digolongkan sebagai force majeure melainkan efisiensi jika perusahaan mengalami kerugian secara terus – menerus selama 2 tahun berturut – turut dan dapat dibuktikan, dengan data audit keuangan perusahaan. Dan PHK karena alasan efisiensi harus dapat dipastikan perusahaan tutup atau perusahaan tutup tidak untuk sementara waktu. Apabila perusahaan melakukan phk dengan alasan tidak sah, maka pekerja dapat melakukan tuntutan dalam gugatannya dengan memuat tuntutan : menuntut agar dipekerjakan kembali atau menuntut hak – hak sesuai dengan Undang – Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Contents of Summary With the Covid-19 pandemic, many companies have been affected by the economic impact of the Covid-19 pandemic, this has resulted in the layoff of employment for workers / laborers reaching 3.05 million delivered by the Government. So that this problem creates a legal event, one of which is legal protection for workers / laborers who have been dismissed during the Covid-19 pandemic. The research methodology is normative legal research with a statutory approach and a case approach taken from primary legal materials, secondary legal materials, and tertiary legal materials. Based on the results of the research on the Covid-19 pandemic outbreak, it is regulated in Perpres no. 12 of 2020 that the Covid-19 pandemic can be classified as a non-natural disaster. So in this case, workers who are subject to termination of employment are not legal if they are classified as force majeure, but rather efficiency if the company has suffered losses continuously for 2 consecutive years and it can be proven, with company financial audit data. And layoffs for efficiency reasons must ensure the company closes or the company closes not for a while. If a company is dismissed for illegitimate reasons, the worker can file a lawsuit in his lawsuit by stating the demands: demanding to be reinstated or claiming rights in accordance with Law Number 13 of 2003 concerning Manpower.
