Ringkasan isi Penangkapan yang dilakukan penyidik adalah suatu bentuk wewenang istimewa yang diberikan oleh undang-undang. Namun, tidak berarti dapat dilakukan dengan sewenang-wenang. Penangkapan merupakan suatu proses hukum yang sangat penting, oleh karena itu penangkapan harus dilakukan secara teliti, hati-hati dan cermat oleh Penyidik. Adapun permasalahan dalam penelitian ini yaitu Bagaimanakah penegakan hukum terhadap penyidik Polri dalam hal terjadinya salah tangkap atau error in persona dan Apakah faktor penghambat penegakan hukum terhadap penyidik Polri dalam hal terjadinya salah tangkap atau error in persona. Penelitian ini menggunakan pendekatan yuridis normative yaitu pendekatan yang didasarkan pada perundang-undangan, teoi-teori dan konsep-konsep yang berhubungan dengan penulisan penelitian berupa asas-asas, nilai-nilai data kepustakaan. Hasil penelitian dan pembahasan menunjukkan bahwa penegakan hukum terhadap penyidik Polri dalam hal terjadinya salah tangkap atau error in persona yaitu berupa pemberian sanksi yang tegas terhadap anggota Polri yang melakukan salah tangkap. Selain proses peradilan pidana yang di lakukan menurut hukum acara yang berlaku di lingkungan peradilan umum, penyidik Polri yang melakukan salah tangkap juga mengikuti sidang disiplin dan sidang kode etik profesi yang saksinya berupa Pemberhentian Tidak Dengan Hormat (PTDH). Faktor yang menjadi penyebab terjadinya salah tangkap oleh penyidik Polri yaitu a. Dinamika Kerja Kompleks, b. Kurangnya SDM Polri, dan c. Proses Penyidikan Yang Sulit. Saran dalam penelitian ini adalah pentingnya ketegasan dalam pemberian sanksi yang diterapkan bagi Polri sebagai penyidik yang melakukan kesalahan penangkapan bukan hanya ditegaskan dalam peraturan tetapi ditegaskan dalam penerapannya. However, it does not mean that it can be done arbitrarily. Arrest is a very important legal process, therefore the arrest must be carried out carefully, carefully and carefully by the Investigator. The problems in this study are how to enforce the law against police investigators in terms of the occurrence of wrong catches or error in person and whether the factors inhibiting law enforcement against police investigators in the event of a wrong catch or error in person. This study uses a normative juridical approach, namely an approach that is based on legislation, theory and concepts related to the writing of research in the form of principles, library data values. The results of the research and discussion indicate that law enforcement against police investigators in the event of wrongful arrest or error in person is in the form of strict sanctions against members of the Indonesian National Police who commit wrongful arrests. In addition to the criminal justice process that is carried out according to the procedural law that applies in the general court environment, police investigators who carry out wrong arrests also attend disciplinary hearings and hear professional profession codes of conduct in the form of Respectful Dismissal (PTDH). Factors that were the cause of the wrong arrest by police investigators were a. Dynamics of Complex Work, b. Lack of Polri HR, and c. Difficult Investigation Process. The suggestion in this study is the importance of the firmness in sanctions applied to the Indonesian National Police as investigators who make arrests wrongfully not only confirmed in the regulations but are confirmed in their application.
