Abstract

Minuman keras menjadi perhatian semua negara karena dampaknya yang bersifat multi efek, termasuk di Indonesia. Dewasa ini minuman keras yang beredar di masyarakat tidak hanya minuman keras yang sah menurut peraturan perundang-undangan (legal), tetapi juga banyak minuman keras yang ilegal. Rumusan masalah dalam skripsi ini adalah mengenai pelaksanaan penegakan hukum yang diatur dalam Perda oleh Satpol PP Jakarta Barat dan mengenai penerapan penegakan hukum melalui putusan pengadilan. Penulis menggunakan dua teori yaitu Teori Kewenangan dan Teori Penegakan Hukum. Menggunakan metode penelitian yuridis normatif yang didukung dengan yuridis empiris. Bahan hukum bersumber dari data primer yaitu data yang diperoleh melalui penelitian di lapangan dan data sekunder yaitu data yang diperoleh dari studi kepustakaan.Tindak pidana minuman beralkohol yang ditegakkan sesuai Perda DKI Jakarta merupakan Tindak Pidana Ringan dan/atau Pelanggaran berupa sanksi administratif yaitu denda dan kurungan. Penerapan Penegakan Hukum terhadap Pelaku yang mengedarkan minuman keras secara ilegal melalui Putusan Pengadilan dapat menggunakan ketentuan pidana dari berbagai dasar hukum yang berbeda-beda diluar Perda dan Pergub./Alcoholic liquor is a concern of all countries because of the multi-effect landscape, including in Indonesia. Currently, liquor circulating in the community is not only alcoholic liquor which is legal according to legislation (legal), but also many ilegal alcoholic liquors.The formulation of the problem in this thesis is regarding the implementation of law enforcement as regulated in Regional Regulations by the West Jakarta Satpol PP and about the application of law enforcement through the courts. The author uses two theories, namely Authority Theory and Law Enforcement Theory. Using normative juridical research methods supported by empirical juridical. Legal materials are sourced from primary data, namely data obtained through research in the field and secondary data, namely data obtained from library studies.The crime of alcoholic beverages which is enforced in accordance with the DKI Jakarta Regional Regulation is a Minor Crime and/or Violation in the form of administrative sanctions in the form of fines and imprisonment. Implementation of Law Enforcement against Perpetrators who distribute liquor ilegally through Court Decisions may use different criminal provisions from various legal bases outside the Perda and Pergub.
