Abstract

Untuk melindungi keselamatan para pekerja guna mewujudkan produktivitas kerja yang optimal, maka diselenggarakan upaya kesehatan dan keselamatan kerja. Perlindungan tenaga kerja bisa timbul karena adanya perjanjian kerja yang disepakti oleh pihak pengusaha dengan pekerja/buruh, sehingga menimbulkan apa yang disebut dengan hubungan kerja. Penelitian ini merupakan penelitian kepustakaan (library research), dengan metode pendekatan yuridis normatif. Dalam memperoleh data sekunder penulis menggunakan bahan hukum primer (Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan), untuk mendukung bahan hukum tersebut, juga dipergunakan bahan hukum sekunder berupa buku, jurnal dan lain-lain. Hasil penelitian menunjukkan bahwa tidak membuat perjanjian kerja antara pengusaha dan pekerja/buruh memberikan dampak yang negatif bagi kedua belah pihak. Perjanjian Kerja merupakan hak pekerja/buruh dan kewajiban dari pengusaha yang dibuat secara tertulis atau lisan. Tidak adanya perjanjian kerja dengan pengusaha menimbulkan kerugian bagi pekerja harian yang mengalami kecelakaan kerja, sehingga tidak mendapatkan pengobatan yang baik dan uang tunai untuk pengobatannya dari perusahaan (sesuai dengan Peraturan Pemerintah Nomor 5 Tahun 2021). Akibat kelalaian perusahaan terhadap Perjanjian Kerja Harian tidak dibuat, pemerintah dapat memberikan sanksi administratif terhadap perusahaan. Sanksi administratif yang diberikan pemerintah berupa teguran tertulis, pembatasan kegiatan usaha, penghentian sementara sebagian atau seluruh alat produksi dan pembekuan kegiatan usaha./ To protect the safety of workers in order to achieve optimal work productivity, work health and safety efforts are carried out. Labor protection can arise because of a work agreement agreed by the employer with the worker/laborer, giving rise to what is called an employment relationship. This research is a library research, with a normative juridical approach. In obtaining secondary data, the author uses primary legal materials (Law No. 13 of 2003 concerning Employment), to support the legal materials, secondary legal materials in the form of books, journals and others are also used. The results of the study indicate that not making a work agreement between the entrepreneur and the worker/labourer has a negative impact on both parties. The Work Agreement is the right of the worker/labourer and the obligation of the entrepreneur which is made in writing or verbally. The absence of a work agreement with the employer causes losses for casual daily workers who have work accidents, so they do not get good treatment and cash for treatment from the company (according to Government Regulation Number 5 of 2021). As a result of the company's negligence in not making a daily casual work agreement, the government can impose administrative sanctions on the company. Administrative sanctions given by the government are in the form of written warnings, restrictions on business activities, temporary suspension of part or all of the means of production and freezing of business activities.
