Abstract

Fiktif Positif merupakan bentuk perlindungan yang diberikan negara kepada masyarakat dalam hal pejabat TUN mengabaikan permohonan penerbitan KTUN yang diajukan oleh masyarakat. Fiktif Positif berdasarkan UU 30/2014 tentang Administrasi Pemerintahan merupakan kewenangan PTUN, namun pasca UU Cipta Kerja berlaku maka PTUN tidak lagi berwenang menangani Fiktif Positif sehingga menghilangkan perlindungan bagi masyarakat. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif dengan pendekatan Perundang-undangan (statute approach) dan Studi kasus (case approach). Penulis menganalisis dan menggambarkan bagaimana pengaturan kewenangan PTUN dalam hal menangani fiktif positif sebelum dan sesudah UU Cipta Kerja berlaku. Hasil yang diperoleh penulis dari penelitian ini antara lain: (1) Pasca berlakunya UU Cipta Kerja, PTUN tidak lagi berwenang menangani perkara fiktif positif (2) Analisis hakim dalam Putusan Nomor 17/P/FP/2020/PTUN.SBY. yang menyatakan bahwa PTUN masih berwenang menangani fiktif positif tidak sesuai dengan UU Cipta Kerja dan Sema Nomor 5 Tahun 2021 Tentang Pemberlakuan Hasil Rapat Pleno Kamar Mahkamah Agung Tahun 2021 Sebagai Pedoman Pelaksanaan Tugas Bagi Pengadilan./ Fictitious Positive is a form of protection provided by the state to the public in the event that TUN officials ignore the application for the issuance of KTUN submitted by the public. Positive fictitious pursuant to Law 30/2014 concerning Government Administration is the authority of the Administrative Court, but after the Employment Creation Law is enacted, the Administrative Court no longer has the authority to handle positive fictitious, thereby eliminating protection for the community. The research method used is a normative juridical research method with a statute approach and studies case. The author analyzes and describes how the administration of PTUN's authority in terms of dealing with positive fictitious matters before and after the Employment Copyright Act comes into effect. The results obtained by the authors from this study include: (1) After the enactment of the Job Creation Law, the Administrative Court is no longer authorized to handle positive fictitious cases (2) Judges' analysis in Decision Number 17/P/FP/2020/PTUN.SBY. which states that the Administrative Court still has the authority to handle positive fictitious actions that are not in accordance with the Job Creation and Sema Law Number 5 of 2021 concerning the Enforcement of the Results of the 2021 Supreme Court Chamber Plenary Meeting as a Guide to the Implementation of Duties for.
