Abstract
Doping adalah penggunaan zat dan/atau metode terlarang untuk meningkatkan prestasi olahraga. Isu hukum yang diangkat oleh penulis tersebut berada dalam tataran filosofis yaitu bersangkutan dengan asas hukum tiada pidana tanpa kesalahan (geen straf zonder schuld), maka penggunaan zat dan/atau metode terlarang oleh olahragawan dapat dipidana jika terbukti dengan alat bukti yang sah dan olahragawan tersebut dapat bertanggung jawab atas perbuatan yang dilakukannya dan juga kemenangan seorang olahragawan harus dengan cara yang bersih dan benar, maka untuk mengetahui dan membahas lebih lanjut mengenai isu hukum tersebut terdapat rumusan masalah dalam penulisan hukum ini yaitu bagaimana pengaturan hukum terkait penggunaan zat dan/atau metode terlarang yang termasuk pelanggaran doping untuk olahragawan di Indonesia dan bagaimana sanksi bagi olahragawan yang menggunakan zat dan/atau metode terlarang yang termasuk pelanggaran doping di Indonesia. Penulisan hukum ini menggunakan metodologi penelitian yuridis normatif, spesifikasi penelitian deskriptif, metode pendekatan undang-undang (statue approach) dan komparatif (comparative approach) untuk mengetahui bahwa penggunaan zat dan/atau metode terlarang oleh olahragawan termasuk pelanggaran doping karena merusak nilai-nilai yang ada dalam olahraga dan belum terdapat sanksi pidana juga peraturan yang lebih tegas untuk menjerat para olahragawan yang melakukan pelanggaran doping tersebut. Kata Kunci: Olahragawan, Doping, dan Sanksi./ Doping is the use of prohibited substances and/or methods to enhance sporting performance. In connection with the legal issues raised by the author, it is at a philosophical level that is concerned with the principle of no criminal law without error (geen straf zonder schuld), then the use of substances and/or prohibited methods by athletes can be punished if proven by valid evidence and the athletes can be responsible for his actions and also where an athlete's victory must be in accordance with a clean and correct manner, so to find out and discuss further about The legal issues contained in the formulation of the problem of writing this law are how the legal regulations regarding the use of prohibited substances and/or methods which include doping violations for athletes in Indonesia are and how are the sanctions for athletes who use prohibited substances and/or methods which include doping violations in Indonesia. This legal writing uses a research methodology with the type of normative juridicial, descriptive research specifications, statue and comparative approach methods to find out that the use of prohibited substances and/or methods by athletes is a doping violation because it destroys the values that e ist in sports and there are no criminal sanctions as well. stricter regulations to ensnare athletes who commit doping offences.
