Abstract

Riset ini dimaksudkan guna mengkaji masalah tentang jaminan perlindungan hukum serta sistem penegakan hukum pada Anak yang bermain judi online, dimana permasalahan yang dirumuskan pada riset ini adalah sejauh mana adanya jaminan perlindungan hukum pada anak yang terlibat sebagai pelaku judi online dan bagaimana penerapannya secara yuridis terhadap anak dalam kapasitasnya sebagai pelaku judi online. Penelitian menggunakan metode yuridis normatif yang dilakukan secara literatif berdasarkan keseluruhan aturan perundang-undangan yang berlaku, serta bersumber pada data sekunder yang dianalisis berdasarkan teori perlindungan hukum dan teori penegakan hukum. Berdasarkan riset ini hasilnya menunjukkan bahwa penegakan hukum pada Anak pelaku judi online harus dibedakan dari orang dewasa dan dilaksanakan berdasarkan Sistem Peradilan Pidana Anak dengan mengkedepankan penerapan sistem peralihan diversi dan keadilan restorasi serta kepentingan terbaik dan kesejahteraan Anak. Hal ini pengaturannya sudah tercakup secara menyeluruh baik dalam instrumen hukum nasional maupun internasional yaitu meliputi perlindungan umum dan perlindungan khusus bagi Anak yang tersangkut masalah pidana, sehingga Anak yang diduga sebagai pelaku judi online memerlukan jaminan perlindungan hukum dalam seluruh tahapan proses peradilan pidana./This study aims to analising the guarantees of legal protection and the law enforcement system applicable to children who commit the criminal offense of online gambling. The research problems addressed in these study are how legal guarantee is for children that committed the crime offense of online gambling and how the law enforcement system is applied to children that committed the criminal offense of online gambling. This studies employing a normative juridical method with a statutored approaching and a conceptual approach, utilizing secondary data analyzed through the theories of legal protection and law enforcement. The findings indicate that law enforcement against children involved in online gambling offenses must differ from that applied to adults and to carrying out in a follow with the Juvenile Criminal Justice System, prioritizing diversion and restorative justice while upholding to be interesting and welfare of the children. Legal protection for children has been comprehensively regulated in both national and international legal instruments, encompassing general protection and specification protectioned for children in conflicted with the law; therefore, children who commit or are alleged to have committed online gambling offenses require guarantees of legal protection throughout all stages of the criminal justice process.
