Abstract

Terdapat perbedaan ketentuan dari UU 21/2021 Tentang Cipta Kerja yang menggantikan UU 13/2003 yang sudah dinyatakan tidak berlaku lagi pada tahun 2023 dan berlanjut resmi diberlakukan PP 35/2022 tentang PKWT, Alih Daya, Waktu Kerja dan Waktu Istirahat dan PHK yang berlaku pada 2 Maret 2022. Selanjutnya maka terbit pula Perpu No.1/2023 tentang Cipta Kerja, yang kemudian berlanjut terbitnya UU No.6/2023 yang berlaku pada 31 Maret 2023 untuk ditetapkan sebagai pengganti Perpu tersebut di atas. Pada riset ini, peneliti memakai Asas Manfaat dan juga Kepastian Hukum. Riset ini sendiri sifatnya normatif dan deskriptif analitif, dimana keseluruhan data diperoleh melalui penelitian kepustakaan dengan teknik studi pustaka dan pendekatan secara yuridis kualitatif. Kesimpulan dari penelitian ini adalah PT Tang Mas menggunakan Peraturan Pemerintah 35 tahun 2021 sebagai acuan Perhitungan Besaran Pesangon yang telah memberlakukan PHK pada 108 pekerja pada Agustus 2019 dengan alasan perusahaan menderita rugi selama dua tahun berturut-turut melalui pembuktian berdasarkan adanya Laporan Keuangan dari Akuntan Publik dan saran bahwa sebaiknya Hakim dapat berpihak kepada Pekerja dalam penentuan Besaran Pesangon para pekerja dan juga untuk PT Tang Mas supaya memproyeksikan dengan tepat kebutuhan pekerja untuk menghindari Resiko PHK yang merupakan sikap terakhir saat mengambil keputusan efisiensi./There are differences in this provisiones of Act No. 11/2020 concerming Job Creationed whitch replaced Law No. 13/2003 which was declared constitutional in 2023 and continued to be officially enforced by PP No. 35/2022 concerming Fix-Tern Enployment Agrement (PKWT), Outsourcing, Worker Hours and Rested Hour and Terminationing of Employmend which came into effect on February 2, 2021. Furthermore, Perpu No. 2/2022 concerning Job Creation was also issued, which was then continued by the issuance of Law No. 6/2023 which came into effect on March 31, 2023 to be determined as a replacement for the Perpu mentioned above. The research, the authorized used the principles of legal certainly, legal utility and normatived legal researching and analytical descriptive while the data obtaining trougher library researcher uses library study data techniques and qualitative judicial aproach. The conclusive of the stydy is that PT Tang Mas uses Government Regulation 35 of 2021 as a reference for calculating the amount of severance pay which has implemented layoffs on 108 workers in Augus 2019 that due to company losses for two consecutive years as proven by financial reports from public accountants and suggestion that the Judge should stand for workers in determining the amount of severance pay and also for PT Tang Mas has to have workers necessary accurately project to avoid Termination of Employment Risk which is the final stance in making efficiency decisions.
