Abstract
Impor dan ekspor limbah sampah adalah kegiatan yang bertujuan untuk daur ulang atau pengolahan lebih lanjut. Namun, praktik ini menimbulkan kontroversi, terutama ketika limbah yang diimpor tidak terkelola dengan baik, sehingga berdampak negatif terhadap lingkungan dan kesehatan. Konvensi Basel membatasi perpindahan limbah berbahaya antarnegara serta mendorong pengelolaan limbah yang ramah lingkungan. Konvensi Basel, yang diratifikasi pada tahun 1989 dan mulai berlaku pada 1992, bertujuan untuk membatasi perpindahan limbah berbahaya antarnegara, khususnya dari negara maju ke negara berkembang. Penelitian ini membahas implementasi Konvensi Basel dalam kebijakan impor limbah sampah di Indonesia, terkhususnya di Jawa Timur. Sejak tahun 2018, peningkatan impor limbah sampah ilegal di Indonesia meningkat dengan sangat pesat. Hasil penelitian pada rentan waktu 2016-2019 menunjukkan bahwa terdapat ancaman keamanan lingkungan akibat dari impor limbah sampah ilegal di Indonesia. Dengan menggunakan teori hukum lingkungan internasional dan konsep keamanan lingkungan, penelitian ini diharapkan dapat menjawab masalah yang terjadi. Selain itu, peneliti melakukan penelitian dengan metodologi kualitatif deskriptif-analisis. Temuan penelitian ini menunjukkan bahwa meskipun Indonesia telah meratifikasi Konvensi Basel, implementasinya masih menghadapi berbagai hambatan, termasuk lemahnya pengawasan, regulasi yang tumpang tindih, serta kepentingan ekonomi dalam industri daur ulang. Akibatnya, terjadi paradoks di mana kebijakan yang seharusnya melindungi lingkungan justru membuka celah bagi masuknya limbah sampah ilegal yang merusak ekosistem dan mengancam kesehatan masyarakat. However, this practice has sparked controversy, especially when imported waste is not properly managed, leading to negative environmental and health impacts. The Basel Convention regulates the transboundary movement of hazardous waste and promotes environmentally sound waste management. Ratified in 1989 and enforced in 1992, the Basel Convention aims to restrict the transfer of hazardous waste between countries, particularly from developed to developing nations. This study examines the implementation of the Basel Convention in Indonesia's waste import policies, particularly in East Java. Since 2018, illegal waste imports in Indonesia have surged significantly. Findings from the 2016–2019 period indicate that illegal waste imports pose a threat to environmental security in Indonesia. Using the theory of international environmental law and the concept of environmental security, this study seeks to address the issues at hand. Additionally, the research employs a descriptive-analytical method. The findings reveal that despite Indonesia's ratification of the Basel Convention, its implementation faces multiple obstacles, including weak enforcement, overlapping regulations, and economic interests in the recycling industry. Consequently, a paradox emerges where policies intended to protect the environment instead create loopholes that allow the entry of illegal waste, ultimately harming ecosystems and threatening public health.
