Abstract

Pencemaran nama baik dikenal juga dengan istilah penghinaan, yang pada dasarnya adalah menyerang nama baik dan kehormatan seseorang yang bukan dalam arti seksual, sehingga orang itu merasa dirugikan. Oleh sebab itu, menyerang salah satu diantara kehormatan atau nama baik sudah cukup dijadikan alasan untuk menuduh seseorang telah melakukan penghinaan. Penelitian ini merupakan jenis penelitian hukum normatif yang bersifat deskriptif. Jenis data yang dipakai dalam penelitian ini adalah data sekunder. Teknik pengumpulan data yang dipergunakan adalah studi pustaka. Analisis data menggunakan metode yuridis kualitatif. Berdasarkan penelitian yang dilakukan, bentuk-bentuk tindak pidana pencemaran nama baik yaitu penghinaan materil, penghinaan formal. Sistem pengaturan tindak pidana pencemaran nama baik yaitu Undang-Undang Nomor 1 Tahun 2024 Tentang Perubahan Kedua atas Undang-Undang Informasi Dan Transaksi Elektronik Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik. Pidana, Pencemaran Nama Baik, Media Internet / Defamation is also known as insult, which is basically attacking someone's good name and honor in a non-sexual sense, so that the person feels aggrieved. Therefore, attacking one's honor or good name is sufficient reason to accuse someone of committing an insult. This research is a type of descriptive normative legal research. The type of data used in this research is secondary data. The data collection technique used is library research. Data analysis uses qualitative juridical methods. Based on research conducted, the forms of criminal acts of defamation are material insults and formal insults. The system for regulating criminal acts of defamation is Law Number 1 of 2024 concerning the Second Amendment to the Information and Electronic Transactions Law Number 11 of 2008 concerning Electronic Information and Transactions.
