Abstract

Riset ini membahasa pertimbangan hakim dalam menjatuhkan hukuman pada pelaku tindak perdagangan migran berdasarkan Putusan Nomor 400/Pid.Sus/2023/PN Dum. Tujuannya ialah untuk mengetahui alasan hakim memberikan hukuman yang tergolong ringan dan menilai apakah putusan tersebut sudah mencerminkan keadilan dan kepastian hukum. Metode riset yang dipergunakan ialah yuridis normatif dengan pendekatan studi kasus. Hasil riset membuktikan bahwasanya hukuman yang dijatuhkan belum memberikan rasa keadilan bagi korban karena hakim lebih mempertimbangkan hal yang meringankan pelaku. Oleh karenanya, butuh adanya penerapan hukuman yang lebih tegas agar mampu memberikan efek jera dan perlindungan bagi korban./This study examines the judge’s considerations in sentencing perpetrators of migrant trafficking based on Court Decision No. 400/Pid.Sus/2023/PN Dum. The purpose is to analyze the reasons behind the light sentence and assess whether the decision reflects justice and legal certainty. The research uses a normative juridical method with a case study approach. The results show that the sentence did not fully provide justice for the victims as the judges focused more on mitigating factors for the perpetrators. Therefore, stricter punishments are needed to ensure justice and deterrence.
