Abstract

Masyarakat adat Dampek di Desa Satar Padut, Kecamatan Lamba Leda, Kabupaten Manggarai Timur masih mempertahankan sistem pewarisan berdasarkan hukum adat yang bersifat patrilineal. Dalam praktiknya, pembagian warisan tanah sering kali menimbulkan sengketa karena tidak adanya dokumentasi resmi, perbedaan tafsir terhadap adat, serta campur tangan pihak luar keluarga. Rumusan masalah dalam penelitian ini adalah mengapa terjadi sengketa tanah waris di Dampek Desa Satar Padut Kecamatan Lamba Leda Kabupaten Manggarai Timur dan bagaimana upaya penyelesaian sengketa tanah waris di Dampek Desa Satar Padut Kecamatan Lamba Leda Kabupaten Manggarai Timur. Penelitian ini menggunakan metode empiris yang bersandar pada penggunaan sumber data primer dengan menggunakan bahan hukum primer, sekunder, dan data hukum tersier. Penelitian juga menggunakan analisa data dengan pendekatan kualitatif. Teori yang digunakan dalam penelitian ini adalah teori keadilan dan teori penegakan hukum. Hasil penelitian menunjukkan bahwa sistem pembagian warisan tanah secara adat, yang dikenal dengan konsep lodok, memainkan peran penting dalam struktur sosial masyarakat Dampek. Penyelesaian sengketa melalui lembaga adat dianggap lebih efektif dan mencerminkan keadilan menurut nilai lokal, meskipun sering kali belum memiliki kekuatan hukum formal menurut negara. / The indigenous Dampek community in Satar Padut Village, Lamba Leda Sub-district, East Manggarai Regency, continues to uphold a patrilineal inheritance system based on customary law. In practice, the division of inherited land often gives rise to disputes due to the lack of official documentation, differing interpretations of custom, and interference from parties outside the family. This research addresses the following questions: why do land inheritance disputes occur in Dampek, Satar Padut Village, Lamba Leda Sub-district, East Manggarai Regency, and what efforts are made to resolve these disputes? This study employs an empirical method, relying on primary data sources and using primary, secondary, and tertiary legal materials. The research also applies a qualitative approach to data analysis. The theories employed are the theory of justice and the theory of law enforcement. The findings reveal that the customary system of land inheritance, known as the lodok concept, plays a crucial role in the social structure of the Dampek community. Dispute resolution through customary institutions is considered more effective and reflective of justice based on local values, although it often lacks formal legal recognition by the state.
