Abstract

Anak merupakan generasi penerus bangsa, tetapi di zaman ini seringkali ditemui anak menjadi korban kekerasan seksual. Perlindungan hukum terhadap anak haruslah mendapat perhatian yang serius. Rumusan masalah dalam skripsi ini adalah bagaimana bentuk perlindungan hukum terhadap anak yang menjadi korban tidak pidana pedofilia, dan bagamaina pertimbangan hukum hakim terhadap dakwaan pelaku pedofilia berdasarkan Putusan Nomor 63/Pid.Sus/2023/PN. Tte. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer yaitu Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak, Kitab Undang-Undang Hukum Pidana dan putusan Pengadilan Negeri Nomor 63/Pid.Sus/2023/PN. Tte serta menggunakan bahan hukum sekunder berupa buku-buku yang terkait dengan topik penelitian. Bahan hukum tersebut kemudian disusun dan dianalisis. Hasil penelitian ini dapat disimpulkan bahwa bentuk perlindungan hukum terhadap anak dalam UU Perlindungan Anak berupa konseling, rehabilitasi, bantuan medis dan bantuan hukum. Pertimbangan hukum hakim dalam Putusan Nomor 63/Pid.Sus/2023/PN. Tte menjatuhkan putusan pidana penjara 5 tahun terhadap terdakwa dengan mengacu kepada Pasal 82 UU Perlindungan Anak./ Children are the next generation of the nation, but nowadays children are often found to be victims of sexual violence. Legal protection for children must receive serious attention. The formulation of the problem in this thesis is how to provide legal protection for children who are victims of pedophilia crimes, and how the judge's legal considerations regarding the indictment of pedophilia perpetrators are based on Decision Number 63/Pid.Sus/2023/PN. Tte. This research is normative legal research with a statutory approach and a case approach. The data used is secondary data consisting of primary legal materials, namely Law Number 35 of 2014 concerning Child Protection, the Criminal Code and District Court decision Number 63/Pid.Sus/2023/PN. Tte also uses secondary legal materials in the form of books related to the research topic. The legal materials are then compiled and analyzed. The results of this research can be concluded that the forms of legal protection for children in the Child Protection Law are in the form of counseling, rehabilitation, medical assistance and legal assistance. Judge's legal considerations in Decision Number 63/Pid.Sus/2023/PN. Tte sentenced the defendant to 5 years' imprisonment by referring to Article 82 of the Child Protection Law
