Abstract

Di Indonesia masih banyak sekali permasalahan tentang hak asuh anak kepada siapa yang layak untuk diberikan, hal ini terjadi karena putusnya perkawinan orang tua yang menyebabkan pemeliharaan hak asuh anak diperebutkan. Pokok permasalahan pada skripsi ini ialah apakah hak asuh anak yang ada di dalam kandungan dapat dijadikan obyek akibat putusnya perkawinan orang tua dan bagaimana penerapan hukum hakim terhadap anak yang di dalam kandungan dalam kaitannya dengan yang berhak atas pengasuhan anak akibat putusnya pernikahan orangtuanya (Studi Putusan Nomor 8/Pdt.G/2021/PN Prp). Pada riset ini model penelitian yang pergunakan adalah yang bersifat normatif metode literatif khususnya seluruh regulasi yang berlaku yang berkorelasi dengan permasalahan yang sedang diteliti, pendekatan analitis atas kasus-kasus yang relevan dengan topik yang dibahas pada penelitian ini. Jenis data yang digunakan adalah berupa Undang-Undang Perkawinan, dan seperangkat aturan terkait penelitian ini, serta diperoleh dari buku-buku hukum atau jurnal maupun literatur lain. Hasil dari riset bisa disimpulkan bahwa mengenai pengasuhan anak adalah merupakan tanggung jawab dari kedua orang tuanya yang membutuhkan perlindungan serta memutuskan hak asuh dalam sidang perceraian dapat menimbulkan ketidakpastian hukum./In Indonesia, there are still many problems regarding who should give child custody, this occurs because the parents' marriage breaks down, which causes child custody to be contested. The formulation of the problem in this thesis is whether the custody rights of children in the womb can be made an object regulation on the breakup of the parents' marriage and how the judge's application of law to be the womb is related to the child's custody rights as a result of the breakup of the parents' marriage (Decision Study Number 8/ Pdt.G/2021/PN Prp). These studies methodologic used is normative legal research with these statutories approaching, analytical approach and case approach. The typing of information used is the Marriage Law, and a set of regulations related to this research, and obtained from law books or journals or other literature. From these resulting of this research it can be concluding that these custody is the responsibility of both parents who need protection and deciding on custody in a divorce trial can create legal uncertainty
