Abstract

Anak memiliki hak perlindungan hukum yang sama seperti orang dewasa, sebagaimana dijamin dalam Pasal 27 dan Pasal 28B ayat (2) UUD 1945. Konstitusi menegaskan bahwa berhak untuk hidup, tumbuh dan berkembang, serta bebas dari kekerasan dan diskriminasi. Rumusan masalah dalam penelitian ini membahas terkait pertanggungjawaban pidana anak dibawah umur terhadap tindak pidana penganiayaan menyebabkan kematian orang lain, dan penerapan hakim terhadap pelaku pidana anak dibawah umur terhadap tindak pidana penganiyaan menyebabkan kematian orang lain dalam Putusan Nomor: 46/Pid.Sus.Anak/2023/PN.BKS. Metode yang digunakan dalam penelitian ini ialah metode hukum normatif dengan menggunakan metode pendekatan kasus dan perundang-undangan. Jenis data pada penelitian ini ialah data sekunder yang menggunakan bahan hukum primer yaitu KUHP, Undang-Undang Nomor 35 Tahun 2014 Tentang Perlindungan Anak. Hasil yang dapat disimpulkan dari penelitian ini ialah Pertanggungjawaban pelaku penganiayaan yang menyebabkan kematian (3) yang mengancam pidana maksimal 15 tahun. Namun dalam Putusan Nomor: 46/Pid.Sus-Anak/2023/PN.BKS, hakim menerapkan Pasal 80 ayat (1) karena unsur kematian tidak terbukti di persidangan./Children are entitled to equal legal protection as adults, as enshrined in Article 27 and Article 28B paragraph (2) of the 1945 Constitution of the Republic of Indonesia. The Constitution affirms every child’s right to life, growth, development, and freedom from violence and discrimination. This research aims to examine the criminal liability of minors involved in acts of assault resulting in the death of another person, as well as the judicial considerations in the adjudication of such cases, with specific reference to Decision Number: 46/Pid.Sus-Anak/2023/PN.BKS. This study employs a normative juridical research method using statutory and case approaches. The research relies on secondary data, particularly primary legal materials such as the Indonesian Criminal Code (KUHP) and Law Number 35 of 2014 concerning Child Protection. The findings indicate that the criminal liability for assault resulting in death is regulated under the KUHP and the Child Protection Law, specifically Article 80 paragraph (3), which stipulates a maximum sentence of 15 years’ imprisonment. However, in Decision Number: 46/Pid.Sus-Anak/2023/PN.BKS, the panel of judges applied Article 80 paragraph (1) instead, on the grounds that the element of death was not sufficiently proven during trial proceedings.
