Abstract

Lumba-Lumba Hidung Botol Indo-Pasifik (Tursiops Aduncus) ialah satwa liar dilindungi yang berhak mendapatkan kesejahteraan dan perlindungan, tetapi masih banyak Lumba-Lumba Hidung Botol Indo-Pasifik (Tursiops Aduncus) yang ditemukan mati di wilayah konservasi In-Situ dan Ex-Situ yang seharusnya merupakan wilayah yang ditujukan untuk pelestarian tumbuhan dan satwa liar dilindungi. Rumusan masalah dalam skripsi ini ialah bagaimanakah perlindungan hukum terhadap kematian Lumba-Lumba Hidung Botol Indo-Pasifik (Tursiops Aduncus) sebagai satwa yang dilindungi di wilayah konservasi in-situ dan ex-situ, dan apakah ketentuan mengenai pelestarian dan pemanfaatan satwa di konservasi in-situ dan ex-situ mencerminkan prinsip kesejahteraan hewan (animal welfare) berdasarkan tingkah laku alami Lumba-Lumba Hidung Botol Indo-Pasifik (Tursiops Aduncus). Kajian ini menerapkan metode penelitian hukum normatif dengan menggunakan pendekatan undang-undang. Data yang dipakai ialah data sekunder dengan bahan hukum primer yang didapatkan melalui perundang-undangan, bahan hukum sekunder yang diperoleh melalui jurnal, hasil penelitian, dan warta di internet, serta bahan hukum tersier yang didapatkan melalui ensiklopedi, kemudian bahan hukum yang diperoleh ditata dan ditelaah. Dari hasil kajian ini dapat ditarik kesimpulan bahwa Lumba-Lumba Hidung Botol Indo-Pasifik (Tursiops Aduncus) telah mendapatkan perlindungan hukum dari Kitab Undang-Undang Hukum Pidana (KUHP), Peraturan Pemerintah, Peraturan Menteri, dan Peraturan Direktur Jenderal, namun perlindungan tersebut tidak diatur dengan jelas sesuai dengan tingkah laku alami dan kesejahteraan Lumba-Lumba Hidung Botol Indo-Pasifik (Tursiops Aduncus)./ Indo-Pacific Bottlenose Dolphins (Tursiops Aduncus) are protected wildlife that have the right to welfare and protection, but there are still many Indo-Pacific Bottlenose Dolphins (Tursiops Aduncus) found dead in In-Situ and Ex-Situ conservation areas which should be areas designated for the preservation of protected plants and wildlife. The formulation of the problem in this thesis is how is the legal protection for the death of Indo-Pacific Bottlenose Dolphins (Tursiops Aduncus) as protected animals in in-situ and ex-situ conservation areas, and whether the provisions regarding the preservation and utilization of animals in in-situ and ex-situ conservation reflect the principle of animal welfare based on the natural behavior of Indo-Pacific Bottlenose Dolphins (Tursiops Aduncus). This study uses a normative legal research method using a statutory approach. The data used are secondary data with primary legal materials obtained through legislation, secondary legal materials obtained through journals, research results, and news on the internet, and tertiary legal materials obtained through encyclopedias, then the collected legal materials are compiled and analyzed. From the results of this study, it can be concluded that the Indo-Pacific Bottlenose Dolphin (Tursiops Aduncus) has received legal protection from the Criminal Code (KUHP), Government Regulations, Ministerial Regulations, and Director General Regulations, but this protection is not clearly regulated in accordance with the natural behavior and welfare of the Indo-Pacific Bottlenose Dolphin (Tursiops Aduncus).
