Abstract

Dalam proses rehabilitasi, korban penyalahgunaan narkotika bukanlah objek tetapi subjek. Dia termasuk subjek karena berhasil tidaknya proses rehabilitasi sangat ditentukan oleh dia sendiri. Kehadiran peran lain lebih untuk menopang dan membimbingnya dalam melewati tahapan-tahapan rehabilitasi. Dalam hal tertangkap tangan, maka akan terlebih dahulu menjalani proses hukum dan kepadanya tidak terlibat dalam peredaran gelap narkotika yang kemudian diperiksa oleh Tim Assesment Terpadu (TAT) sesuai dengan ketentuan dalam Surat Edaran Mahkamah Agung Nomor 04 Tahun 2010. Sesuai ketentuan Pasal 127 UU Narkotika yang pada intinya bahwa korban penyalahgunaan narkotika berhak mendapatkan hak rehabilitasi. Berdasarkan uraian diatas maka penulis tertarik membuat judul penelitian ini dengann judul: “Tinjauan Mengenai Aspek Hukum yang Mempengaruhi Keberhasilan Program Rehabilitasi Terhadap Korban Penyalahguna Narkotika (Studi Kasus Putusan Pengadilan No:679/Pid.Sus/2023/PN.JKT.TIM)”. Jenis penelitian yuridis normatif yaitu penelitian hukum yang mengutamakan data sekunder, yaitu data yang diperoleh dari bahan-bahan pustaka. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan undang-undang dan dengan metode perbandingan hukum atau komparatif (comparativeapproach). Pengaturan hukum dalam program rehabilitasi korban penyalahgunaan narkotika sesuai dengan prinsip kepastian hukum dapat dilihat melalui ketentuan Pasal 127 Ayat (2) dan (3) UU Narkotika, selain itu menurut ketentuan Pasal 54, 55 dan 103, hakim berwenang menyalahgunakan opioid. Selain itu, menurut pasal 54, 55, dan 103, hakim berwenang memaksa pecandu dan penyalahguna narkotika untuk menjalani rehabilitasi. Namun persyaratan ini harus didukung dengan bukti yang kuat, seperti surat rekomendasi dari Tim Penilai Terpadu (TAT) yang memverifikasi bahwa individu tersebut tidak melakukan pelanggaran yang disengaja. Surat Edaran Mahkamah Agung (SEMA) Republik Indonesia Nomor 4 Tahun 2010 merupakan aturan turunan terkait rehabilitasi yang harus diperhatikan dan dipertimbangkan oleh Majelis Hakim. Secara kepastian hukum dalam praktiknya, hakim yang menerapkan Pasal 127 Ayat (1) terhadap kesalahan Terdakwa tetapi justru tidak mempertimbangkan Ayat berikutnya yaitu pasal 127 Ayat (2) dan (3) UndangUndang No. 35 Tahun 2009 dengan minimal barang bukti pemakaian oleh Penyalahguna. Penerapan rehabilitasi korban penyalahgunaan Narkotika dalam Putusan Pengadilan Nomor 679/Pid.Sus/2023/PN.Jkt.Tim belum memberikan kepastian dan keadilan bagi Terdakwa sebab Terdakwa tidak diberikan hak rehabilitasi secara medis dan sosial hanya diberikan hukuman pidana saja padahal Terdakwa sangat membutuhkan rehabilitasi agar dapat mengembalikan Terdakwa dalam keadaan yang lebih sehat secara fisik dan mental lagi. Pertimbangan Majelis Hakim juga cenderung memberatkan Terdakwa padahal Terdakwa disini juga sebagai korban dari Narkotika itu sendiri. Kata Kunci : Rehabilitasi, Korban, Penyalahgunan. /In the rehabilitation process, victims of narcotics abuse are not objects but subjects. He is a subject because the success or failure of the rehabilitation process is determined by him alone. The presence of other roles is more to support and guide him through the stages of rehabilitation. In the event that he is caught red-handed, he will first undergo a legal process and he will not be involved in the illicit trafficking of narcotics which will then be examined by the Integrated Assessment Team (TAT) in accordance with the provisions in Supreme Court Circular Letter Number 04 of 2010. In accordance with the provisions of Article 127 of the Narcotics Law which In essence, victims of narcotics abuse have the right to rehabilitation. Based on the description above, the author is interested in creating a title for this research with the title: "Overview of Legal Aspects that Influence the Success of Rehabilitation Programs for Victims of Narcotics Abusers (Case Study of Court Decision No: 679/Pid.Sus/2023/PN.JKT.TIM)". This type of normative juridical research is legal research that prioritizes secondary data, namely data obtained from library materials. The approach method used in this research is the statutory approach and the comparative legal method (comparative approach). Regulations for the Rehabilitation of Narcotics Abuse Victims in Indonesia can be seen through the provisions of Article 127 paragraphs (2) and (3) of the Narcotics Law, apart from that, according to the provisions of Articles 54, 55 and 103, judges have the authority to abuse opioids. Apart from that, according to articles 54, 55 and 103, judges have the authority to force drug addicts and abusers to undergo rehabilitation. However, this requirement must be supported by strong evidence, such as a letter of recommendation from the Integrated Assessment Team (TAT) verifying that the individual has not committed an intentional violation. Circular Letter of the Supreme Court (SEMA) of the Republic of Indonesia Number 4 of 2010 is a derivative regulation regarding rehabilitation which must be paid attention to and considered by the Panel of Judges. In terms of legal certainty in practice, judges who apply Article 127 paragraph (1) to the Defendant's mistakes but do not consider the following paragraph, namely Article 127 paragraphs (2) and (3) of Law no. 35 of 2009 with a minimum of evidence of use by the abuser. The implementation of rehabilitation for victims of Narcotics abuse in Court Decision Number 679/Pid.Sus/2023/PN.Jkt.Tim has not provided certainty and justice for the Defendant because the Defendant was not given the right to medical and social rehabilitation, he was only given a criminal sentence even though the Defendant really needed rehabilitation so that can return the Defendant to a healthier condition physically and mentally. The Panel of Judges' considerations also tend to incriminate the Defendant even though the Defendant here is also a victim of Narcotics himself. Keyword : Rehabilitation, Victims, Abuse
