Abstract

Fenomena yang terjadi terkait keputusan Mahkamah Konstitusi mengenai syarat usia calon presiden dan wakil presiden dianggap sebagai inkonstitusional karena sesungguhnya untuk peraturan mengenai batas usia calon presiden dan wakil presiden sudah ditetapkan berdasarkan UU No 7 tahun 2017 dengan syarat usia calon presiden dan wakil presiden adalah sekurang kurangnya 40 tahun. Namun, seperti yang diketahui pada realitas saat ini aturan tersebut diganti seperti yang tertuang pada putusan No 90/PUU XXI/2023 yang menyatakan menjadi berusia paling rendah 40 tahun atau berpengalaman sebagai kepala daerah tingkat provinsi maupun kabupaten/kota. Penelitian ini bertujuan untuk mengeksplorasi dan menganalisis secara mendalam bagaimana mahasiswa memandang atau memahami keputusan Mahkamah Konstitusi ini dan dampak apa yang ditimbulkan dari hal tersebut terhadap dinamika politik dan demokrasi di Indonesia. Metode yang digunakan dalam penelitian adalah kualitatif deskriptif dengan teknik pengumpulan data wawancara mendalam semi struktur. Teori yang digunakan adalah persepsi sosial menurut Jalaludin Rakhmat agar dapat mengetahui bagaimana persepsi mahasiswa dalam menanggapi putusan Mahkamah Konstitusi mengenai syarat calon presiden dan wakil presiden pada putusannya nomor 90/PUU XXI/2023.Adapun hasil temuan dari penelitian ini, yakni persepsi positif dan negatif serta dampak positif dan negatif. Persepsi positif dari mahasiswa bahwa putusan mahkamah konstitusi telah membuka peluang untuk generasi muda dan persepsi negatif dari putusan tersebut adalah terdapat pelanggaran kode etik. Dampak dari putusan mahkamah konstitusi berdasarkan hasil temuan data juga bervariasi, yakni dampak positif dari penelitian ini adalah menjadi pemicu untuk generasi muda dan untuk dampak negatif adalah adanya penolakan dari masyarakat.Kata Kunci:Persepsi Mahasiswa, Putusan Mahkamah Konstitusi, Syarat Calon Presiden dan Wakil, Dampak Demokrasi / Of the phenomenon associated with the constitutional court's decision on the ageof candidates for presidents and vice presidents is considered unconstitutionalbecause it is actual ly established by the 2017 no. 7 law of 2017 that the eligibilityof presidential candidates and vice presidents is at least 40 years old. The method used in researchis a descriptive qualitative with a data collecting technique an in depth interviewof a semi structure. The theory used is social perception according to jalaludinrakhmat in order to find out how the stu dent's perception in response to aconstitutional court ruling on the terms of candidates for President and vicePresident at the verdict number 90/puu xxi/2023. As for the findings of this study,that is, positive and negative perceptions and positive and negative effects.
