Abstract

Penelitian ini menganalisis status hukum dan pertanggungjawaban pidana oleh Kelompok Kriminal Bersenjata (KKB) di Papua. Konflik ini terus menjadi perdebatan di masyarakat. Aksi KKB meliputi serangan bersenjata, pembuunuhan, pembakaran fasilitas umum, dan penguasaan wilayah. Keberadaan KKB menimbulkan ketakutan, pengungsian, serta memperburuk ekonomi dan pembangunan. Dengan tindakan mereka melanggar berbagai ketentuan pidana, termasuk makar, kejahatan terhadap nyawa, ketertiban umum dan kepemilikan senjata ilegal. Penelitian ini menggunakan pendekatan perundang-undangan dengan data yang digunakan adalah data sekunder yang didukung oleh bahan primer dan sekunder. Hasil penelitian menunjukkan bahwa penetapan KKB sebagai teroris kurang tepat. Status hukum yang lebih sesuai adalah Kelompok Separatisme Bersenjata (KSB) dan KKB karena aksi mereka berorientasi pada pemisahan diri dari NKRI. Pertanggungjawaban pidana terhadap KKB berpedoman pada Pasal 104–110 KUHP tentang kejahatan terhadap keamanan negara dan beberapa pasal mengenai kejahatan-kejahatan dalam Buku ke II KUHP. Penelitian ini menyarankan penegakan hukum yang lebih tegas serta peraturan khusus untuk menghindari ketidakpastian dalam penerapan sanksi pidana/This study analyzes the legal status and criminal liability of Armed Criminal Groups (KKB) in Papua. This conflict continues to be a debate in society. The KKB's actions include armed attacks, looting, burning of public facilities, and territorial control. The existence of the KKB causes fear, displacement, and worsens the economy and development. With their actions they violated various criminal provisions, including treason, crimes against life, public order and illegal possession of weapons. This study uses a legislative approach with the data used being secondary data supported by primary and secondary materials. The results of the study show that the determination of the KKB as a terrorist is not appropriate. The more appropriate legal status is the Armed Separatist Group (KSB) and the KKB because their actions are oriented towards secession from the Republic of Indonesia. Criminal liability for the KKB is guided by Articles 104–110 of the Criminal Code concerning crimes against state security and several articles regarding crimes in Book II of the Criminal Code. This study suggests stricter law enforcement as well as special regulations to avoid uncertainty in the application of criminal sanctions.
