Abstract
Indonesia menjadi negara yang mewajibkan sertifikasi halal untuk produk bahan pangan impor. Hal ini membuat salah satu negara anggota WTO yaitu Brazil menggugat Indonesia ke DSB WTO dengan tuduhan Indonesia telah melakukan diskriminasi terhadap produknya. Fenomena pemberlakuan sertifikasi halal untuk produk bahan pangan impor tidak hanya dilakukan oleh Indonesia, negara-negara anggota WTO lainnya juga menerapkan hal yang sama. Rumusan masalah dalam skripsi ini adalah apakah Sertifikasi Halal dikategorikan sebagai hambatan perdagangan internasional oleh WTO dan bagaimana pemberlakuan Sertifikasi Halal produk bahan pangan impor di Indonesia kepada negara anggota WTO yang tidak memiliki lembaga halal. Penelitian yang digunakan ialah penelitian hukum normatif dengan pendekatan perundang-undangan, kasus, dan konsep. Data penelitian berupa data sekunder berupa bahan hukum primer: perjanjian internasional dan peraturan nasional Indonesia, serta menggunakan buku-buku dan jurnal yang menunjang penelitian. Adapun hasil temuan sekaligus kesimpulan dari penulis terhadap penelitian ini yaitu Status dan Kedudukan sertifikasi halal baik di antara negara-negara anggota WTO atau di WTO telah memberi penjelasan bahwa, praktik sertifikasi halal telah menjadi praktik kebiasaan internasional yang pemberlakuannya bisa diterima oleh setiap negara anggota WTO dan tidak dikategorikan sebagai hambatan perdagangan internasional, sehingga WTO harus mengakui sertifikasi halal atau menambahkannya dalam lampiran TBT Agreement. / Indonesia has become a country that requires halal certification for imported food products. This has led one of the WTO member countries, Brazil, to sue Indonesia at the WTO DSB, accusing Indonesia of discriminating against its products. The phenomenon of implementing halal certification for imported food products is not only carried out by Indonesia; other WTO member countries also implement the same. The problem formulation in this thesis is whether Halal Certification is categorized as a barrier to international trade by the WTOand how the implementation of Halal Certification for imported food products in Indonesia affects WTOmember countries that do not have Halal certification bodies. The research used is normative legal research with an approach based on legislation, case law, and concepts. The research data consists of secondary data in the form of primary legal materials: international agreements and Indonesian national regulations, as well as books and journals that support the research. The outcome and conclusions of the Author regarding this research are that the Status and Position of halal certification, both among WTO member countries and within the WTO, have explained that the practice of halal certification has become an international customary practice that can be accepted by every WTO member country and is not categorized as a barrier to international trade, so the WTO must recognize halal certification or added to the annex of the TBT Agreement.
