Abstract

Pengadaan tanah untuk pembangunan Jakarta International Stadium (JIS) berdampak pada masyarakat Kampung Bayam yang kehilangan tempat tinggal sebagai gantinya Pemprov DKI Jakarta dan Jakpro berjanji membangun Kampung Susun Bayam sebagai hunian pengganti. Selesai dibangun, masyarakat Kampung Bayam tak kunjung mendapatkan hak atas unit untuk menghuni dan mengelola Kampung Susun Bayam tersebut dan kini menjadi terlantar. Rumusan masalahnya yaitu: apakah pengadaan tanah dalam pembangunan JIS termasuk kepentingan umum? bagaimana pemenuhan hak atas tempat tinggal yang layak bagi masyarakat Kampung Bayam yang terdampak pembangunan JIS? Penelitian ini dilakukan dengan metode penelitian hukum normatif dengan jenis data sekunder yang dianalisis dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitiannya adalah: pertama, pengadaan tanah untuk pembangunan Jakarta International Stadium termasuk pengadaan tanah dalam kepentingan umum berdasarkan Pasal 10 huruf o dan q UU No. 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum. Kedua, pemenuhan hak tempat tinggal yang layak bagi masyarakat Kampung Bayam yang terdampak pembangunan JIS dapat dilakukan dengan memberikan unit Kampung Susun Bayam sesuai tanggungjawab hukum yang diatur Kepgub 878/2018 dan Kepgub 979/2022, serta Surat Walikota Jakarta Utara nomor e-0176/PU.04.00 perihal Data Verifikasi Warga Calon Penghuni Kampung Susun Bayam. "/" Land acquisition for the construction of the Jakarta International Stadium (JIS) has had an impact on the people of Kampung Bayam who lost their homes. In return, the DKI Jakarta Provincial Government and Jakpro promised to build Kampung Susun Bayam as a replacement housing. After it was built, the people of Kampung Bayam have not received the rights to the units to live in and manage the Kampung Susun Bayam and are now abandoned. The formulation of the problem is: is land acquisition in the construction of JIS included in the public interest? How is the fulfillment of the right to decent housing for the people of Kampung Bayam who are affected by the construction of JIS? This research was conducted using a normative legal research method with secondary data types analyzed using a statutory approach and a case approach. The results of the research are: first, land acquisition for the construction of the Jakarta International Stadium is included in land acquisition in the public interest based on Article 10 letters o and q of Law No. 2 of 2012 concerning Land Acquisition for Development in the Public Interest. Second, the fulfillment of the right to decent housing for the people of Kampung Bayam affected by the JIS construction can be done by providing Kampung Susun Bayam units in accordance with the legal responsibilities regulated by the Governor's Decree 878/2018 and the Governor's Decree 979/2022, as well as the Letter of the Mayor of North Jakarta number e-0176/PU.04.00 concerning Verification Data for Prospective Residents of Kampung Susun Bayam.
