Abstract

Pengedar narkoba ialah individu atau kelompok yang terlibat dalam distribusi atau penyebaran narkotika secara ilegal bertujuan untuk beroleh keuntungan finansial. Hal ini sangat berbahaya sebab membantu meningkatnya penyalahgunaan narkotika di masyarakat dan memperburuk masalah sosial dan kriminal. Kasus pengedar narkotika yang melibatkan penegak hukum menjadi masalah yang sangat serius karena mengancam kepercayaan publik terhadap lembaga penegak hukum. Tujuan dari penelitian ini untuk menemukan faktor yang mendorong anggota kepolisian yang terlibat peredaran narkotika, serta dampak sosial dan hukum yang ditimbulkannya. Penelitian ini menggunakan penelitian hukum normatif dengan pendekatan kasus. Data yang digunakan ialah data sekunder berupa bahan hukum primer : Kitab Undang-Undang Hukum Pidana, Buku Hukum Narkotika & Psikotropika, sedangkan bahan hukum sekunder diperoleh dari buku-buku maupun literatur, bahan hukum tertier berupa jurnal & internet, lalu bahan hukum yang terkumpul disusun & dianilisis. Penelitian ini, disimpulkan bahwa kasus Putusan Nomor 96/Pid.Sus/2023/PN.Jkt.Brt Terdakwa Teddy Minahasa terbukti terlibat dalam jaringan peredaran narkotika yang melanggar hukum, pelaku dapat Pidana Mati. Berdasarkan “Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika”, peredaran narkotika dalam jumlah besar bisa mengancam keselamatan masyarakat dan negara, sehingga Undang-Undang ini memberikan sanksi tegas, termasuk Pidana Mati, dan Terdakwa sebagai pejabat kepolisian yang terlibat dalam peredaran narkoba, berpotensi Pidana Mati jika terbukti bersalah./Drug dealers are individuals or groups involved in the illegal distribution or spread of narcotics with the aim of gaining financial gain. This is very dangerous because it helps increase drug abuse in society and worsens social and criminal problems. Narcotics trafficking cases involving law enforcement are a very serious problem because they threaten public trust in law enforcement agencies. The aim of this research is to find the factors that encourage police officers to become involved in narcotics trafficking, as well as the social and legal impacts this causes. This research uses normative legal research with a case approach. The data used is secondary data in the form of primary legal materials: Criminal Code, Narcotics & Psychotropics Law Books, while secondary legal materials are obtained from books and literature, tertiary legal materials are in the form of journals & the internet, then the collected legal materials are compiled & analyzed. This research concluded that in the case of Decision Number 96/Pid.Sus/2023/PN.Jkt.Brt, the defendant Teddy Minahasa was proven to be involved in an unlawful narcotics distribution network, the perpetrator could receive the death penalty. Based on Law Number 35 of 2009 concerning Narcotics, the distribution of large quantities of narcotics can threaten the safety of society and the state, so this Law provides strict sanctions, including the Death Penalty, and the Defendant as a police official involved in drug trafficking, could potentially face the Death Penalty if proven guilty.
