Abstract

Pada awalnya judi hanya dimainkan secara tradisional misalnya secara tatap muka, namun dengan berkembangnya teknologi terutama interne perjudian kemudian berkembang melalui media internet, namun kurang efektif dalam mengaplikasikan pembuktiannya pada perjudian online dalam (studi kasus putusan No. 134 / Pid.B / 2020 / PN.Bta). Berdasarkan uraian diatas, permasalahan yang mendasarinya adalah bagaimana hokum pembuktian terhadap kejahatan judi online dalam hokum acara pidana dan penerapan hokum pembuktian dalam penyidikan perkara. Gaya dan penelitian yang digunakan dalam penelitian ini adalah hokum normative penelitian standard meneliti bibliografi atau bahan sekunder, yang meliputi bahan primer, sekunder, dan undang-undang. Penelitian ini menggunakan metode sastra yang didasarkan pada studi pustaka, buku-buku ilmiah, peraturan perundang-undangan yang berkaitan dengan surat kabar dan mata kuliah untuk memecahkan permasalahan tersebut. Dalam hasil penelitian diketahui bahwa proses pembuktian judi online dilakukan berdasarkan KUHAP yang dilakukan pada tahap pembuktian di pengadilan dengan prosedur penyidikan biasa menggunakan alat bukti yang sah menurut KUHAP. Based on the description above, the underlying problem is how is the law of evidence against online gambling crimes in criminal procedural law and the application of the law of proof in case investigations. The style and research used in this study is standard normative research researching bibliography or secondary materials, which include primary, secondary, and statutory materials. This research uses literary methods based on literature studies, scientific books, laws and regulations related to newspapers and courses to solve these problems. In the results of the study it was found that the process of proving online gambling was carried out based on the Criminal Procedure Code which was carried out at the stage of proof in court with ordinary investigative procedures using valid evidence according to the Criminal Procedure Code. Criminal Procedure Code, but not as an attachment to the book regulated in the ITE Law.
