Abstract
ABSTRAK Judul Disertasi : Kedudukan Kreditor Yang Memiliki Hak Eksekusi Perdata Dalam Pelaksanaan Perdamaian Yang Dihomologasi Untuk Restrukturisasi Pembangunan Hukum Kepailitan Indoneisa Kata Kunci : Kepailitan, Perdamaian, Homologasi, Eksekusi Putusan, Acara Perdamaian Kepailitan Pada hakikatnya setiap utang harus dibayar, terhadap utang yang jatuh tempo maka pelaksanaan eksekusinya dapat dilakukan atas permohonan para kreditur melalui proses kepailitan. UU Kepailitan memberikan kesempatan untuk diajukannya perdamaian yang menjadi Solusi agar debitur diberi kesempatan untuk menyelesaikan semua piutang secara bertanggung jawab. Salah satu persoalan hukum dalam pelaksanaan hukum kepailitan terjadi dalam rangka upaya hukum perusahaan Coal Planning and Mining Corporation dalam menuntut haknya atas utang yang harus dibayarkan PT Polysindo Eka Perkasa. Permasalahan dalam penelitian ini mengenai kedudukan dan upaya hukum kreditor yang tidak masuk dalam putusan perdamaian yang telah dihomologasi dalam kerangka Undang-Undang Kepailitan dan PKPU, dan kreditor yang memiliki putusan hukum dari pengadilan negeri yang telah berkekuatan hukum tetap dalam rangka pemenuhan haknya dapat melakukan eksekusi terhadap aset debitor, pihak-pihak yang ada sebagai pelaksana (Kreditur, Debitur, Debitur Pailit, Hakim Pengawas dan Kurator) hukum acara Kepailitan telah bekerja sesuai prinsip-prinsip hukum dan memberikan perlindungan hukum bagi semua kreditor secara adil untuk mendapatkan pemenuhan haknya sebagaimana prinsip paritas creditorium dan prinsip-prinsip hukum lainnya yang diakui dan berlaku dalam KUHPer, dan Apakah asas hukum lex specialis derogate lex generally tidak lagi berlaku/berakhir, setelah putusan perdamaian yang dihomologasi diterima dan kepailitan dinyatakan berakhir, meskipun pelaksanaan dari isi akta perdamaian yang telah dihomologasi masih berjalan untuk mememuhi kewajaiban debitor kepada kreditor. Pada penelitian ini digunakan 3 (tiga) teori yang digunakan sebagai pisau analisis yaitu teori negara kesejahteraan (welfare state), Teori Keadilan, dan Teori Hukum kepailitan. Penelitian ini merupakan penelitian hukum normatif-empiris dengan pendekatan Perundang-undangan (Statute Approach) ,Pendekatan Kasus (Case Aproach) ,Pendekatan Konseptual (Conceptual Approach), Pendekatan Perbandingan Hukum(Comparative Aproach) dan Pendekatan Filosofis (phylosophical aproach).Data yang digunakan adalah data primer dan data Sekunder.Bahan hukum yang digunakan terdiri dari bahan hukum primer,sekunder dan tersier. Teknik Analisa yang digunakan dalam penelitian ini adalah teknik analisis data Preskriptif dan teknik analisis studi kepustakaan (law in books). Peneltian ini bertujuan untuk menyimpulkan Kedudukan dan upaya hukum kreditor yang tidak masuk dalam putusan yang telah dihomologasi dalam kerangka UU KPKPU berlandaskan paritas creditorium adalah sama, serta pihak-pihak yang ada sebagaimana hukum acara kepailitan telah bekerja sesuai prinsip-prinsip hukum perlu menjadi suatu upaya untuk evaluasi bagi para pihak-pihak dalam hukum kepailitan. Asas hukum lex specialis derogate legi generali tidak lagi berlaku/berakhir setelah putusan perdamaian yang dihomologasi dan kepailitan berkahir merupakan suatu ketentuan dalam hukum kepailitan dimana kondisi kepailitan akan berakhir apabila perjanjian perdamaian telah disepakati dan dihomogasi. // ABCTRACT Disertation Title : The Position of Creditors with Execution Rights in the Implementation of Homologated Settlement in the Restructuring of Bankruptcy Law in Indonesia. Keywords : Bankruptcy, Settlement, Homologation, and Execution of Judgment Essentially, every debt must be paid, and for debts that have matured, execution can be carried out at the request of creditors through the bankruptcy process. The Bankruptcy Law provides an opportunity to propose a settlement, which serves as a solution for the debtor to be given a chance to responsibly settle all debts. One of the legal issues in the implementation of bankruptcy law arose from the legal actions of the Coal Planning and Mining Corporation in pursuing its rights over the debt that must be paid by PT Polysindo Eka Perkasa. The problem in this research concerns the position and legal remedies of creditors who were not included in the homologated settlement decision within the framework of the Bankruptcy and PKPU Law, and creditors who have a final and binding legal decision from the district court in order to fulfill their rights by executing the debtor's assets. The parties involved, such as the creditor, debtor, bankrupt debtor, supervising judge, and curator, in the bankruptcy proceedings have acted in accordance with legal principles and provided legal protection for all creditors fairly in order to fulfill their rights, in line with the principle of paritas creditorium and other legal principles recognized and applicable in the Civil Code (KUHPer). This research also questions whether the legal principle lex specialis derogat lex generali no longer applies/ends after the homologated settlement is accepted and the bankruptcy is declared over, even though the execution of the contents of the homologated peace agreement is still ongoing to fulfill the debtor's obligations to the creditors. In this study, three theories are used as analytical tools: the welfare state theory, the theory of justice, and the theory of bankruptcy law. This research is a normative-empirical legal study with a Statute Approach, Case Approach, Conceptual Approach, Comparative Approach, and Philosophical Approach. The data used includes primary and secondary data. The legal materials consist of primary, secondary, and tertiary sources. The analysis techniques applied in this research are prescriptive data analysis and library study analysis (law in books). This research aims to conclude the position and legal remedies for creditors not included in a court decision that has been homologated within the framework of the Bankruptcy Law (UU KPKPU), based on the principle of "paritas creditorium" (equal treatment of creditors). Additionally, it seeks to evaluate whether the parties involved, as stipulated by bankruptcy procedural law, have acted in accordance with legal principles, which should serve as an evaluation effort for the parties in bankruptcy law. The legal principle of lex specialis derogat legi generali no longer applies/ends after the homologated peace agreement and the conclusion of the bankruptcy, as stipulated in bankruptcy law. Bankruptcy is considered resolved when the peace agreement has been reached and homologated
