ABSTRAK Nama : Hot Asi Simamora NIM : 1940050166 Program Studi : Hukum Judul : PERLINDUNGAN HUKUM KONSUMEN RUMAH SUSUN EASTON PARK RESIDENCE JATINANGOR YANG BELUM MELAKSANAKAN PENANDATANGANAN AKTA JUAL BELI SAMPAI SAAT DEBITUR DALAM PAILIT, Studi Kasus Easton Park Residence Jatinangor Halaman : i-ix 103 Halaman + Daftar Pustaka +Lampiran Kata Kunci : Syarat Sahnya Peralihan Kepemilikan Satuan Rumah Susun Ringkasan Isi : Dengan penetapan kawasan Jatinangor menjadi Kawasan Strategis Pendidikan di Propinsi Jawa Barat, mendorong beberapa perguruan tinggi unggulan seperti Institut Teknologi Bandung, dan Universitas Padjajaran, memindahkan sebagian aktivitas perkuliahan di kawasan Jatinangor. Hal ini mendorong perkembangan peningkatan jumlah penduduk sebagai akibat masuknya penduduk luar Jatinangor untuk menempuh Pendidikan tinggi. Permintaan akan tempat hunian pun meningkat tajam. PT Kalmar Jaya sebagai salah satu perusahaan yang bergerak di bidang property menangkap peluang usaha yang cukup menjanjikan sehingga pada Tahun 2012, mulai membangun Rumah Susun yang dikenal dengan Easton Park Residence Jatinangor, pada lokasi yang sangat strategis yaitu di Jalan Raya Jatinangor. Dan ternyata, PT Kalmar Jaya tidak salah melakukan investasi, karena terbukti dalam masa pembangunan, terjual lebih dari 1.000 (seribu) unit sarusun dari 1.538 (seribu lima ratus tiga puluh delapan) satuan rumah rumah susun yang dibangun. Dalam perikatan jual beli satuan rumah susun antara konsumen dengan penjual dimulai dengan booking fee, yang dilanjutkan dengan membayar Down Payment 1 seminggu setelah membayar booking fee, lalu kemudian melakukan pembayaran lunas sesuai harga yang disepakati. Setelah konsumen melakukan pembayaran atas satuan rumah susun, pengembang menyerahkan unit rumah susun yang diikuti dengan penandatangan Berita Acara Serah Terima Unit. Setelah menguasai secara fisik, konsumen mulai mengisi satuan rumah susun dengan segala kelengkapan seperti pemasangan pemanas air, melengkapi dengan dapur, lemari dapur, lemari pakaian, meja belajar, tempat tidur, AC, bahkan sebagian ada yang memasang karpet atau parkit pada lantai dan memasang wall paper. Selanjutnya, ada yang langsung menempati sendiri namun tak sedikit juga yang memang menyewakan kepada pihak lain. September 2022, PT Kalmar Jaya mendaftarkan secara sukarela untuk permohonan PKPU melalui Pengadilan Niaga Jakarta Pusat. Dalam perkembangan persidangan PKPU, kreditur tidak melihat adanya keseriusan dari debitur untuk membuat rencana penyelesaian hutang kepada kreditur. Hal ini mengakibatkan pada persidangan ketiga di Bulan Desembaer 2022, kreditur menolak perpanjangan PKPU dan juga Proposal Perdamaian yang diajukan. Akibatnya, Pengadilan Niaga Jakarta Pusat memutuskan pailit. Dengan keputusan pailit, tentu seluruh asset debitur akan dilelang dan hasil penjualan asset akan digunakan untuk membayar hutang-hutang kepada kreditur. Bagi konsumen EPRJ yang hanya tinggal proses AJB dihadapan PPAT supaya bisa diteruskan proses Balik Nama aau pengalihan kepemilikan, memohon kepada hakim pengawas melalui curator, agar diputuskan untuk On Going Concern, sehingga debitur bisa meneruskan usahanya menyelesaikan kewajiban berupa pembuatan AJB dihadapan PPAT.
