Abstract

Di Indonesia saat ini para penegak hukum memiliki langkah produktif untuk memproses suatu tindak pidana yaitu dengan melibatkan peran pelaku yang bekerjasama justice collaborator. Keuntungan penerapan Justice Collaborator ini pemecahan kasus lebih singkat, meminimalisir kemungkinan adanya perkara yang terbengkalai dan untuk memberikan perlindungan bagi saksi pelaku yang berperan penting untuk mengungkap kejahatan terorganisasi. Rumusan Masalah Pada Penelitian ini adalah Bagaimana ketentuan peraturan Justice Collaborator dalam Tindak Pidana Narkotika, Bagaimana perlindungan hukum bagi Justice Collaborator dalam Tindak Pidana Narkotika di Indonesia. Penelitian yang digunakan adalah hukum normatif. normatif adalah penelitian yang dilakukan atau ditujukan pada peraturan yang tertulis atau bahan hukum yang melalui penelitian pustaka ataupun melalui studi dokumen. Penelitian hukum normatif adalah yang ditujukan untuk mendapatkan hukum yang objektif. Dari hasil Penelitian ini dapat disimpulkan (justice collaborator) dalam hal penerapannya tidak diatur dalam undang-undang Indonesia akan tetapi dalam praktek penerapan hukum pidana sehingga mulai diatur dalam hukum positif di Indonesia melalui ratifikasi undang-undang yang berasal dari dokumen internasional, perlindungan hukum, khususnya justice collabolator yang mana membantu terselesaikannya perkara yang sedang ditegakkan oleh para penegak hukum terkhusus pada kasus tindak pidana narkotika yang mana dalam hal ini Perlindungan terhadap rasa aman kepada Justice Collaborator berupa perlindungan terhadap diri mereka. / In Indonesia, law enforcers currently have productive steps to process a criminal offense, namely by involving the role of perpetrators who work together as justice collaborators. The advantage of applying this Justice Collaborator is shorter case solving, minimizing the possibility of abandoned cases and to provide protection for perpetrator witnesses who play an important role in uncovering organized crime. The formulation of the problem in this study is how the provisions of the Justice Collaborator regulation in Narcotics Crimes, how is the legal protection for Justice collaborators in Narcotics Crimes in Indonesia. The research used is normative law. normative is research conducted or aimed at written regulations or legal materials through library research or through document studies. Normative legal research is aimed at obtaining objective law. From the results of this research, it can be concluded that (justice collaborator) in terms of its application it is not regulated in Indonesian law, but in practice the application of criminal law is starting to be regulated in positive law in Indonesia through the ratification of laws originating from international documents, legal protection, in particular justice collabolator which helps resolve cases that are being enforced by law enforcers, especially in cases of narcotics crimes, in this case protection of the justice collaborator's sense of security in the form of protection for themselves.
