Abstract

A. Nama : Richard Patasik Siahaan B. NIM : 1940050133 C. Judul : Perlindungan Hukum Terhadap Masyarakat Indonesia Dari Penyebaran Informasi Diskriminatif Berbasis Sara Melalui Media Sosial D. Halaman : 80 E. Kata Kunci : Penyebaran Informasi Diskriminatif Berbasis Sara Media Sosial F. Ringkasan Isi : Penelitian ini bertujuan untuk mengeksplorasi perlindungan hukum yang diberikan kepada masyarakat dalam menghadapi penyebaran informasi diskriminatif berbasis SARA melalui media sosial. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan normatif yuridis. Melalui analisis normatif, penelitian ini mencoba mendapatkan gambaran secara umum tentang kerangka hukum yang ada untuk melindungi masyarakat dari dampak negatif informasi diskriminatif.. Hasil penelitian menunjukkan bahwa penyebaran informasi diskriminatif berbasis SARA melalui media sosial dapat mengancam keamanan dan kenyamanan masyarakat. Oleh karena itu, diperlukan perlindungan hukum yang cukup bagi masyarakat yang menjadi korban penyebaran informasi diskriminatif tersebut. Terlihat bahwa tindakan penyebaran informasi diskriminatif berbasis SARA melalui media sosial sebagai tindakan yang dapat merusak hubungan antar suku, agama, ras, dan antargolongan. Pengadilan juga menegaskan bahwa tindakan tersebut merupakan tindakan pidana yang dapat dikenakan sanksi hukum. Dari hasil penelitian ini, dapat disimpulkan bahwa perlindungan hukum yang cukup bagi masyarakat sangat penting untuk mencegah penyebaran informasi diskriminatif berbasis SARA melalui media sosial. Selain itu, penegakan hukum yang tegas terhadap pelaku penyebaran informasi diskriminatif tersebut juga perlu dilakukan guna memberikan efek jera kepada pelaku dan mencegah terjadinya tindakan serupa di masa depan. This study uses a normative juridical approach by conducting research on the example of the South Jakarta District Court Decision 628/Pid.Sus/2021/Pn Jkt.Sel as a case example. The results of the study show that the dissemination of discriminatory information based on SARA through social media can threaten the safety and comfort of the community. Therefore, sufficient legal protection is needed for people who are victims of the dissemination of discriminatory information. It can be seen that the act of spreading discriminatory information based on SARA through social media is an act that can damage relations between ethnic groups, religions, races, and groups. The court also emphasized that the said act was a criminal act that could be subject to legal sanctions. From the results of this study, it can be concluded that sufficient legal protection for the community is very important to prevent the spread of discriminatory information based on SARA through social media. In addition, strict law enforcement against the perpetrators of discriminatory information dissemination also needs to be carried out in order to provide a deterrent effect to the perpetrators and prevent similar actions from occurring in the future.
