Abstract

Advokat yang menjalankan Secondment adalah ketika seorang advokat secara sementara bergabung dengan tim hukum internal organisasi untuk membantu proyek tertentu, memberikan keahlian hukum, atau hanya memberi tumpangan kepada tim yang ada dengan beban kerja sehari-hari mereka, tanpa menjadi anggota tetap dari organisasi. Metode yang digunakan dalam penulisan ini adalah yuridis normatif yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Bahan pustaka yang dipergunakan adalah perundangundangan, buku-buku, jurnal, website dan sebagainya serta kamus besar hukum. Hasil dari penelitian ini menunjukkan bahwa jenis perjanjian untuk melakukan pekerjaan yang dipakai oleh Secondment adalah perjanjian untuk melakukan jasa-jasa tertentu karena Advokat di dalam pekerjaannya sebagai Secondment melakukan suatu jasa terhadap klien berupa penasehat, memberikan keahlian, dan mengurusi day to day bussines di divisi hukum dari klien tersebut. Adapun Advokat yang menjalankan Secondment tidak dapat dikatakan sebagai pelanggaran atas Pasal 20 ayat (2) Undangundang Nomor 18 Tahun 2003 Tentang Advokat karena tidak terpenuhinya unsur-unsur dalam pasal tersebut. / A legal secondment is where a lawyer temporarily joins an in-house legal team of an organization to help with a specific project, provides legal expertise or simply gives a lift to existing teams with their day-to-day workload, without becoming a permanent member of the organization. The method used in this study is normative judicial method conducted by researching legal literature or secondary data. Library research sourced from stautory regulations, books, journals, websites and so on as well as a legal dictionary. The result of this study indicate that the type of agreemnt to do work used by Secondment is an agreement to perform certain services because Advocates in their work as Secondment do a service to clients in the form of advisors, provide expertise, and take care of day to day bussiness in the legal division from that clients. In this Secondment, the one who conducts work relations is the law firm with the client. A legal Secondment cannot be said to be a violation of Clause 20 paragraph (2) of the Advocate Law because the elements in the Clause are not fulfilled.
