Abstract

Dalam melakukan transaksi elektronik terdapat pula perjanjian elektronik. Didalam perjanjian elektronik dibubuhi tanda tangan elektronik. Penggunaan tanda tangan elektronik pada suatu dokumen elektronik dapat menjamin keamanan suatu pesan informasi elektronik, tanda tangan elektronik dibuat berdasarkan teknologi kriptografi asimetris. Rumusan masalah dalam skripsi ini adalah sejauh mana kekuatan hukum tanda tangan elektronik dalam suatu transaksi bisnis, dan apakah semua tanda tangan elektronik yang ditanda tangani oleh para pihak sah secara hukum. Penelitian ini merupakan penelitian kepustakaan (library research). Dalam penelitian ini, penulis menggunakan bahan hukum primer, sekunder, dan tersier. Bahan hukum primer dalam penelitian ini adalah UndangUndang Nomor 19 Tahun 2016 tentang Perubahan atas UU No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, PP No. 82 Tahun 2012 tentang Penyelenggaraan Sistem dan Transaksi Elektronik, sedangkan bahan hukum sekunder diperoleh dari buku-buku maupun literature, bahan hukum tersier diperoleh menggunakan internet. Hasil penelitian menunjukkan bahwa tanda tangan elektronik memiliki kekuatan hukum yang sah dan akibat hukum seperti tanda tangan manual pada umumnya yang dijelaskan dalam Pasal 11 ayat 1 UndangUndang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, dan keabsahan tanda tangan elektronik dijelaskan dalam Pasal 5 ayat 1 dan 2, dan dijelaskan dalam Pasal 53 ayat 1 dan 2 Peraturan Pemerintah Nomor 82 Tahun 2012 tentang Penyelenggaraan Sistem dan Transaksi Elektronik. / In conducting electronic transactions there are also electronic agreements. In the electronic agreement, an electronic signature is signed. The use of electronic signatures in electronic documents can guarantee the security of electronic information messages, electronic signatures are based on asymmetric cryptographic technology. The formulation of the problem in this thesis is the extent of the legal strength of electronic signatures in a business transaction, and whether all electronic signatures signed by the parties are legally valid. This research is a library research. In this study, the authors use primary, secondary and tertiary legal materials. The primary legal material in this study is Law Number 19 Year 2016 concerning Amendments to Law No. 11 of 2008 concerning Information and Electronic Transactions, PP No. 82 of 2012 concerning the Implementation of Electronic Transactions and Systems, while secondary legal materials are obtained from books and literature, tertiary legal materials are obtained using the internet. The results showed that electronic signatures have legal force and legal consequences such as manual signatures generally described in Article 11 act 1 of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions , and the validity of electronic signatures are explained in Article 5 act 1 and 2, and explained in Article 53 act 1 and 2 of Government Regulation No. 82/2012 concerning the Implementation of Electronic Transactions and Systems.
