Abstract

Proses pemilihan wakil rakyat untuk dijadikan suaranya dalam badan perwakilan rakyat dilakukan melalui pemilihan umum. Oleh karena anggota Dewan Perwakilan Rakyat merupakan wakil partai politik dalam menjalankan fungsinya, maka mereka wajib mentaati segala peraturan perundang-undangan dan arahan yang dikeluarkan oleh partai politik. Argumentasi tersebut diperkuat dengan adanya sistem pergantian antar waktu (PAW). Penelitian ini menggunakan metodologi penelitian yuridis normatif. Daftar pustaka atau data sekunder, yang terdiri atas bahan hukum primer, sekunder, dan perbendaharaan, merupakan komponen penting dalam penelitian normatif yang komprehensif. Pendekatan perpustakaan digunakan dalam penelitian ini, yang didasarkan pada tinjauan literatur, buku-buku ilmiah, artikel surat kabar, dan Internet. Hasil dari penelitian ini dapat disimpulkan bahwa, pertama mekanisme Penggantian Antar Waktu diatur didalam Undang-undang Nomor 17 tahun 2014 Tentang MPR, DPR, DPD dan DPRD dan Undang-undang Nomer 22 Tahun 2003 Tentang Susunan Dan Kedudukan MPR, DPR, DPD, DPRD. / The process of choosing the representatives of the people to serve as their voice in the people's representative body is carried out through general elections. Because members of the People's Representative Council are representatives of political parties in its operation, they are obligated to abide by all laws and directives issued by the political party. This argument is strengthened by the fact that there is an interim replacement system (PAW). This study employed normative juridical research methodology. A bibliography or secondary data, consisting of primary, secondary, and treasury legal materials, is an essential component of comprehensive normative research. The library approach is employed in this study, which is based on literature reviews, scientific books, newspaper articles, and the Internet. The result of this research concludes, firstly the interim replacement mechanical system (PAW; Pergantian Antar Waktu) regulates under the Act No. 17 year 2014 on People’s Consultative Assembly (MPR), House of Representatives (DPR), Regional Representative Board (DPD) and Regional House of Representatives (DPRD) and on Act No. 22 year 2003 on structural and positional of MPR, DPR, DPD, DPRD. Because Indonesia as a nation applies a rightful open proportional elections is second most voted.
